Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> RESOLUTION #94-01-013 <br /> RESOLUTION ADOPTING FINDINGS OF FACT #351 REGARDING THE <br /> CONDITIONAL USE PERMIT ISSUED TO DANNY'S TRANNY'S, INC. <br /> WHEREAS, Danny's Tranny's, Inc., hereinafter referred to as "Permit Holder", has a <br /> Conditional Use Permit to disassemble engines and transmissions and conduct wholesale <br /> operations in the Industrial District on the property legally described as follows: <br /> Lot 2, 3 and 4, Gateway North Industrial Park Plat 42, Anoka County, Minnesota <br /> (the "Site") <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1) That the Permit Holder properly applied for a conditional use permit to disassemble engines <br /> and transmissions and conduct wholesale operations in the Industrial District and the <br /> Planning and Zoning Commission conducted a public hearing on June 1, 1993, on this <br /> application. <br /> 2) That the Ramsey City Council approved the request for a conditional use permit on June <br /> 22, 1993 (the "CUP"). <br /> 3) That the following violations of the terms of the CUP have been documented by the City: <br /> a) Operations commenced prior to the construction of the building, which operations <br /> included the loading and unloading of materials, transportation of material from the <br /> Site to Lot 1, Block 4, Gateway North Industrial Park Plat 42, and sorting of materials; <br /> b) Exterior storage of equipment, debris, inoperable equipment and materials waiting to <br /> be prepared for processing on Lot 1, Block 4, Gateway North Industrial Park Plat 42; <br /> c) Area being used for parking, loading and maneuvering are not hardsurfaced; <br /> d) Loading and unloading not being conducted wholly within a building; <br /> e) `Traffic being generated that contributes to congestion of public streets such as loading <br /> and unloading operations and off-street parking extending into road right-of-way; <br /> f) Site not being policed regularly to ensure orderly aesthetic conditions; <br /> g) Outside storage of semi-trailers of the Site in violation of Item 419 of the CUP <br /> h) Preparation of feedstock for the aluminum recycling facility on Lot 1, Block 4, <br /> Gateway North Industrial Park Plat 42. <br /> (hereinafter "the violations") <br />
