Couneilmember Hardin introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #94-02-017 <br /> <br />RESOLUTION RE-CERTIFYING ASSESSMENTS FOR PROJECT #85-2 <br />(COUNTY FUND NUMBER 1228) DUE TO THE RESULTING SPLIT INTO <br />RIVER'S BEND THIRD ADDITION <br /> <br /> WHEREAS, Resolution #85-197 adopted the assessment roll related to Project #85-2, <br />described as the portion of project #84-12 benefiting underlying PIN g25-32-25-43-0028; and <br /> <br /> WHEREAS, during 1988 the underlying PIN #25-32-25-43-0028 was split into PIN <br />#25-32-25-43-0042 and PIN g25-32-25-43-0043 by the County of Anoka; and <br /> <br /> WHEREAS, the property owners of resulting PIN #25-32-25-43-0043 prepaid the <br />special assessments related to project #85-2; and <br /> <br /> WHEREAS, the County was notified of this prepayment and was informed that the <br />remaining balance of special assessments were to be placed on PIN #25-32-25-43-0042; and <br /> <br /> WHEREAS, the County inadvertently removed all remaining assessments from payable <br />1989 forward, that should have been collected under PIN ff25-32-25-43-0042; and <br /> <br />WHEREAS, these assessments remain payable to the City of Ramsey; and <br /> <br /> WHEREAS, during 1993, PIN #25-32-25-43-0042 was further split into thirteen parcels <br />to which the remaining assessments would have been split; and <br /> <br />and <br /> <br />WHEREAS, three of the resulting parcels have since been sold from the original owner;, <br /> <br /> WHEREAS, the remaining balance of $93,161.86 should be placed back on the County <br />records and spread between the remaining ten commercial and residential parcels. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That such assessment, a copy of which is attached hereto and made a part hereof, is hereby <br />accepted and shall constitute the special assessment against the properties named herein, <br />and each tract of land therein included is hereby found to have benefited from the original <br />improvement in the amount of the assessment levied against it. <br /> <br />2) <br /> <br />That such assessment shall be payable in equal annual installments extending over a period <br />of seven years. The first of the installments is to be payable with the property taxes <br />payable in 1994 and shall bear interest at 10.4, the rate as originally certified. <br /> <br />3) <br /> <br />The owner of any property so assessed may, at any time pay the whole of the assessment <br />on such property to the City Finance Officer, with interest accrued to December 31 of the <br />year in which such payment is made. Such payment must be made before November 14 or <br />interest will be charged through December 31 of the next succeeding year. <br /> <br />4) <br /> <br />That the Finance Officer shall forthwith transmit a certified copy of this resolution to the <br />County Auditor to be extended on the proper tax lists of the county, and such assessments <br />shall be collected and paid over in the same manner as other municipal taxes. <br /> <br /> <br />
