Counciknember Peterson introduced the fonowing resolution and moved for its adoption: <br /> RESOLUTION #94-02-020 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A TEMPORARY <br />CONDITIONAL USE PERMIT FOR THE ESTABLISHMENT AND OPERATION <br />OF AN ALTERNATE FUEL SUPPLY TEST DEMONSTRATION FACILITY, <br />BASED ON FINDINGS OF FACT g0352 AND DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Kaltec of Minnesota, Inc. has properly applied for a temporary conditional <br />use permit on the property generally known as 14730 Sunfish Lake Blvd. N.W. and legally <br />described as follows: <br /> <br />The South one-half of the Southeast Quarter of Section 22, Township 32, Range 25, <br />Anoka County, Minnesota. <br /> <br />("Site) and; <br /> <br /> WHEREAS, the Planning met on February 1, 1994 and conducted a public hearing and <br />recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Term. This permit shall expire on February 8, 1995. Ail structures, equipment, supplies, <br />materials and operations residue shall be removed from the Site by said expiration date. In <br />the event Kaltec fails to comply with the terms of this CUP, the City may, upon seven (7) <br />days' written notice, enter onto the property and perform all such obligations, the costs of <br />which shall be borne by Kaltee or, in default thereof, by its surety. <br /> <br />Site Development. The development and operation of the facility shall be specifically <br />limited to that described in Kaltec's application and description dated January 11, 1994, <br />together with site plans attached thereto. <br /> <br />Noise and Odor. Noises emanating from the site and operations shall be in compliance <br />with and regulated by the State of Minnesota Pollution Control Standards, Minnesota <br />Regulations MPC, as amended except as modified herein by City requirements. Upon any <br />legitimate and substantiated complaint of noise or odor received by the City, Kaltec shall be <br />notified and will have twenty-four (24) hours to put a corrective action plan in place and <br />seven (7) days to remedy the problem. <br /> <br />Hours of Operation. The hours of operation of the test facility shall be permitted at 24 <br />hours per day. <br /> <br />Control of Operations. Operations must be conducted so as to minimize noise, safety, <br />odor, visual impacts or other nuisance concerns to adjacent residential properties. <br />On-Site Fire Protection. Kaltec shall be responsible for any fire suppression costs <br />required at the facility. <br /> <br />Traffic. Truck traffic shall utilize U.S. Highway #10 and Sunfish Lake Boulevard N.W. <br />(County Road 57) exclusively when traveling to and from the facility. <br /> <br /> <br />
