Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #95-01-017 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT g0371 TO REZONE CERTAIN <br />PROPERTY FROM R-I RURAL RESIDENTIAL AND B-2 BUSINESS TO <br /> R-3 URBAN RESIDENTIAL <br /> <br /> WHEREAS, the City received an application for site plan approval to expand Ramsey <br />Elementary School and it has been determined that a rezoning of the subject property to R-3 Urban <br />Residential is necessary to accommodate the expansion. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That Anoka Hennepin Independent School District No. 11 is proposing to expand Ramsey <br />Elementary School and has acquired two parcels south of the existing school site to <br />accommodate the expansion. <br /> <br />That the existing school site is zoned R- 1 Rural Residential and the acquired parcels to the <br />south are zoned B-2 Business, for which schools are not a permitted use. To expand the <br />lawful non-conforming structure would require a conditional use permit or a rezoning of <br />the property to R-3 Urban Residential, for which schools are a permitted use. <br /> <br />That Anoka Hennepin Independent School District No. 11, hereinafter referred to as <br />"Applicant", has requested the rezoning of certain property from R-1 Rural Residential and <br />B-2 Business to R-3 Urban Residential. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on January 3, 1995 and that said public hearing was properly advertised and <br />that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />5. That the property proposed to be rezoned is legally described as follows: <br /> <br />All that part of the South Half of the Southeast Quarter of Section 23, Township 32, Range <br />25, Anoka County Minnesota, lying west of the public road known as Nowthen Boulevard <br />N.W., excepting therefrom a triangle containing 1/2 square rod described as follows to-wit: <br />Commencing at the Southwest comer of said South Half of the Southeast Quarter of <br />Section 23; thence North along the West line thereof a distance of 16-1/2 feet; thence in a <br />Southeasterly direction to a point on the South line of said South Half of the Southeast <br />Quarter which is distant 16-1/2 feet East of the Southwest corner thereof; thence West on <br />said South line a distance of 16-1/2 feet to the point of beginning. Subject to an easement <br />for road purposes over a tract of land that lies between a parallel line Southwesterly of and <br />60 feet distant of the following described line: Commencing at the Northeast comer <br />Section 26, Township 32, Range 25; thence West on the North line of said Section 26, a <br />distance of 431.45 feet to the point of beginning; thence Northwesterly at an angle of 119 <br />degrees, 15 minutes (when measured from East to North) 1,550.00 feet and there <br />terminating. <br /> <br />EXCEPT: All that part of the Southeast Quarter of the Southeast Quarter of Section 23, <br />Township 32, Range 25, Anoka County, Minnesota, described as follows: Commencing <br />at a point on the South line of said Southeast Quarter of the Southeast Quarter a distance of <br />431.45 feet West of the Southeast comer of said Southeast Quarter of the Southeast <br /> <br />Resolution #95-01-017 <br />Page I of 3 <br /> <br /> <br />
