RESOLUTION #97-01-011 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />FOR THE EXPANSION OF A PROPANE AIR PEAKING PLANT BASED ON <br />FINDINGS OF FACT #0415 AND DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, NORAM ENERGY MANAGEMENT (Permittee) has properly applied for <br />a conditional use permit (CUP) on the property generally known as 7615 173rd Avenue N.W. <br />and legally described as follows: <br /> <br /> All that part of the Southeast Quarter of the Southwest Quarter of Section 4, Township <br />32, Range 25, Anoka County, Minnesota lying east of a line parallel with and 700 feet west of <br />the east line of said Southeast Quarter of the southwest Quarter and extending to the south line <br />thereof (excluding therefrom the east 250 feet thereof) as measured between parallel lines <br />(excluding easement of record). <br /> <br />("Site) and; <br /> <br /> WHEREAS, the Planning Commission met on December 3, 1996 and conducted a <br />public hearing and recommended City Council approval of the request based on Findings of Fact <br />#0415. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Term. This permit shall be perpetual in its duration so long as the conditions imposed <br />herein are complied with. <br /> <br />2. Site Development. The development and operation of the facility shall be specifically <br />limited to that described in NorAm's application consisting of a "Propane Air Peaking Plant <br />Description" and a site plan entitled "NorAm Energy Management, Inc., Ramsey Shaving Plant, <br />Enlarged Grading Plot Plan", prepared by Plant Systems Incorporated and dated May 12, 1997, <br />and attached hereto as Exhibits A and B respectively. <br /> <br />3. Noise and Odor. Noises emanating from the site and operations shall be in compliance <br />with and regulated by the State of Minnesota Pollution Control Standards. Upon any legitimate <br />and substantiated complaint of noise or odor received by the City, the Permittee shall be notified <br />and will have twenty-four (24) hours to put a corrective action plan in place and seven (7) days to <br />remedy the problem. <br /> <br />4. Hours of Operation. The hours of operation of the test facility shall be permitted at 24 <br />hours per day. <br /> <br />5. Control of Operations. Operations must be conducted so as to minimize noise, safety, <br />odor, visual impacts or other nuisance concerns to adjacent residential properties. The security <br />fencing on the site will be upgraded to include barbed wire on top to enhance its effectiveness. <br /> <br />6. On-Site Fire Protection. The Permittee shall be responsible for operating the facility in <br />compliance with the National Fire Protection Association Booklet #59. The <br /> <br /> <br />
