Councilmember Haas Steffen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 97-01-015 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF <br />PERMIT BASED ON FINDINGS OF FACT #0417 AND <br />PERMIT FOR GRADING AND FILLING <br /> <br />A CONDITIONAL USE <br />DECLARING TERMS OF <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 97-01-014 adopting Findings <br />of Fact ~0417 for grading and filling and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On January 14, 1997, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") <br />to John Peterson ("Permittee") for filling operations on the property located in the Southwest Quarter <br />of the Southwest Quarter of Section 3, Township 32, Range 25, Anoka County, Minnesota, to <br />provide benefit to the Northeast Quarter of the Northeast Quarter of Section 9, Township 32, Range <br />25, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />The Permittee shall re-establish natural drainage by replacing the existing 12 inch culvert, with <br />a 15 inch smooth interior culvert. The culvert shall include a flared end section on the upstream <br />side to enhance flow characteristics. The culvert shall be set no greater than 0.1 feet higher <br />than the invert of the downstream corrugated metal pipe culvert. The culvert material may be <br />polyethylene, but it shall conform to class I reinforced concrete pipe strength specification. <br />The culvert shall be installed within 45 days of approval of the Permit by City Council so that it <br />will be functional to handle precipitation/melt events which occur in the Spring of 1997. <br /> <br />The Permittee shall stabilize the back slopes of the fill over those sections of the roadway <br />which have been elevated more than 12 inches from the filling. This shall be done by placing <br />straw over the roadway and backslopes and seeding the backslope and outermost five feet of <br />the roadway with oats or annual rye. This work should be completed prior to April 15, 1997. <br /> <br />The Permittee shall regrade all borrow areas such that the slope is no greater than three <br />horizontal to one vertical. The slopes should be seeded with oats or annual rye and mulched <br />with straw. This work should be completed by June 15, 1997. <br /> <br />With the exception of topsoils, no additional fill beyond that which currently exists will be <br />placed on the site. <br /> <br />o <br /> <br />All costs incurred by the City in executing and administering this permit shall be the <br />responsibility of the Permittee. The Pennittee shall maintain a minimum balance of Three <br />Hundred Dollars and no/cents ($300.00) in an escrow account with the City. This escrow <br />shall be used to reimburse the City for expenses incurred in the administration of the Permit. <br />At the time all conditions specified in this Permit have been met, the balance of the escrow shall <br />be returned to the Permittee. <br /> <br /> <br />
