Mr. Foster stated that he worked with John Oliver and
Associates at the time the lot survey for Lot 16, Block 6 of River's Bend
Properties was drawn up. The lot survey that was drawn neglected to
reflect a 10' drainage easement on the northern boundary. The lot has been
sold and the PUrchaser's hane choice just fits on the lot. The drainage
easement problem was discovered, City Engineer Raatikka was approached
regarding vacating 5' of the drainage easement. City Engineer Raatikka
determined that it was not feasible because of the depth of the drainage
pipe and the potential for damage to the home foundation. River's Bend is
now requesting a variance on the southern boundary fran 10' to 5'.

Camnissioner Deemer suggested reversing the floor plan of the hane.

Mr. Foster replied that the purchaser wants the hane, as originally drawn,
on this particular lot.

Mike Hadtrath - 14693 Waco - Stated that the positioning of the home with a
5' variance on the southern boundary has been staked and if it is buil t as
staked, he has no problem with it. Mr. Hadtrath's hane is on Lot 17.

Mr. & Mrs. Dague - Reside on Lot 15 - Stated they have no objection to the
granting of a variance to Lot 16.
Board of Adjustment/February 26, 1987
