<br />resolution declaring the results of the November 8 General

<br />RIBBON CAMPAIGN
<br />
<br />The Minnesota Chapter of Mothers Against Drunk Drivers
<br />(MADD) is sponsoring a Red Ribbon Campaign. The purpose
<br />of the campaign is to remind people not to drink and drive
<br />during the holidays. It will run from November 15 through
<br />January 2.
<br />All State vehicles, including State Police as well as city
<br />vehicles in Minneapolis and St. Paul will have Red Ribbons
<br />supplied by MADD to tie on their cars. All police departments
<br />in Anoka County have also agreed to participate in the pro-
<br />gram. Anoka County vehicles will carry Red Ribbons as well.
<br />The private sector is also involved in the program. A
<br />number of major corporations including U.S. West, NSP,
<br />Minnegasco, and Abbott-Northwestern will have Red Ribbons
<br />for their company cars and for distribution to their
<br />employees.
<br />The campaign kick-off will be November 15, 1988. The
<br />Governor, the Mayors from St. Paul and Minneapolis, Col-
<br />onel Roger Ledding from the Minnesota State Police and Paul
<br />Tschida, Commissioner of Public Safety are among the
<br />dignitaries expected at the press conference.
<br />Med-Centers, through Bozel Jacobs Public Relations Firm,
<br />will sponsor a Holiday package to be distributed through three
<br />liquor concerns and Med Center locations. The package con-
<br />sists of Designated Driver buttons, Sober Car stickers, a
<br />bumper sticker, non-alcoholic drink recipes and "How to
<br />Host a Holiday Non-Alcoholic Party" instructions. Bert
<br />Johnson, OWl Facilitator in the Anoka County Corrections
<br />department and member of MADD, has arranged for
<br />packages to be distributed to County employees.

<br />A POLICE DEPARTMENT
<br />
<br />The City of Ramsey received a petition proposing to amend
<br />the City Charter to include a Chapter which would require
<br />that the City of Ramsey maintain a police department con-
<br />sisting of a Chief of Police and members as may be provid-
<br />ed for by the City Council. The added Chapter would also
<br />provide for details such as how appointments are made,
<br />duties of a Chief of Police, duties of officers, conduct re-
<br />quirements of officers, and a method for establishing rules
<br />and regulations for the Department.
<br />Due to statutory (State Law) requirements regarding
<br />deadlines for having information submitted for inclusion on
<br />the absentee ballots, the question could not be placed on
<br />the November general election ballot. Consequently, unless
<br />the City Council unanimously adopts the proposed charter
<br />amendment upon the recommendation of the Charter Com-
<br />mission, a special election must be held to consider the
<br />question.
<br />The Charter Commission met on October 20, made some
<br />minor language modifications to the proposed charter
<br />amendment and recommended that City Council adopt the
<br />amendment in order to forego the cost of a special election.
<br />Prior to Council adoption of the Charter amendment, the
<br />peitition circulating committee must agree to the modifica-
<br />tions to the proposed amendment. Members of that com-
<br />mittee were present at the October 25th Council meeting
<br />stating their agreement with the modifications. City Council
<br />then voted unanimously to introduce the ordinance to amend
<br />the City Charter to include a chapter entitled' 'Police Depart-
<br />ment. "
<br />On November 15, the City Council scheduled a Public hear-
<br />ing for December 13th at 7:30 p.m. regarding the proposed
<br />Charter Amendment. Council will have the opportunity to
<br />adopt that amendment following the public hearing. By a
<br />unanimous vote, the Charter would then be amended pro-
<br />vided over a period of 60 days a petition is not received from
<br />at least 2% of the registered voters opposing the amend-
<br />ment. If there is opposition, the amendment must go to a
<br />vote of the public.
<br />For your information, the following is the proposed amend-
<br />ment to the City Charter:
<br />
<br />Section 13.01. Department Created. A police department for
<br />the City shall forthwith be established as permanent and shall
<br />consist of a Chief of Police and such other officers and
<br />members as may be provided for by the Council.
<br />
<br />Section 13.02. Appointments. The Chief of Police shall be
<br />appointed by the Council. All other appointments to or pro-
<br />motions within the department shall be made as provided
<br />by law.
<br />Section 13.03. Rank. The Chief of Police shall be the head
<br />of the department and have supervision over all officers and
<br />members therof.
<br />
<br />Section 13.04. Duties of Chief. The Chief of Police shall keep
<br />such records and make such reports concerning the activities
<br />of the police department as may be required by Statute or
<br />by the Ctiy Council. The Chief shall be responsible for the
<br />performance by the pOlice department of its functions, and
<br />all persons who are members of the police department shall
<br />serve subject to the orders of the Chief of Police.
<br />
<br />Section 13.03. Duties. It shall be the duty of the officers of
<br />the police department to see to the enforcement of all of
<br />the ordinances of the City and all statutes applicable therein,
<br />and to preserve order and prevent infractions of the law and
<br />arrest violators thereof.

<br />In this issue of the Newsletter you will find the text of the
<br />new Snowmobile ordinance which becomes effective
<br />December 18, 1988. I would like to make a few comments
<br />on it for explanatory purposes and also because I like to read
<br />myself in print!
<br />
<br />This came about because of the' 'bull elephant" (related to
<br />the previously referred to "bull-buffalo" type) type that just
<br />insisted on doing nothing but wreaking havoc with
<br />snowmobiles tearing up and down streets, into peoples yards
<br />and generally being stupid in their behavior. While some may
<br />think this too harsh, there was pressure, believe me, to not
<br />allow snowmobiles on any streets in Ramsey in order to rid
<br />the city of the B.E.'s (see above). This ordinance is, I believe,
<br />a fair compromise which still recognizes the legitimacy of
<br />snowmobiling as a recreational activity but also respects the
<br />public safety aspect and, hopefully, lowers the nuisance im-
<br />pact. We will be enforcing it strictly and, because of the
<br />Newsletter advertising, there will be only a short "warning"
<br />period before tags are issued and machines towed. We will
<br />have copies of the ordinance at the city hall and also copies
<br />of the Department of Natural Resources informational pam-
<br />phlet which spells out the State Laws applying to
<br />snowmobiles. There should then be no reason for all
<br />owners/riders of snowmobiles not to be aware of the rules
<br />and regulations that must be followed.

<br />110.011 Purpose:
<br />The purpose of this section is to provide reasonable
<br />regulations for the use of snowmobiles on public and
<br />private property in the City of Ramsey. This section is
<br />not intended to allow what the Minnesota State Statutes
<br />expressly prohibit nor to prohibit what the State Statutes
<br />allow. It is intended to prevent a public nuisance.
<br />
<br />110.012 Incorporation of State Statute:
<br />Any person operating a snowmobile within the City of
<br />Ramsey, unless provided otherwise herein, shall be sub-
<br />ject to the provisions of Minnesota Statutes, Section 84.81
<br />through 84.929, inclusive, as amended, and the regula-
<br />tions of the Commissioner of Natural Resources, "Com-
<br />missioner" adopted pursuant thereto.
<br />
<br />110.013 Definitions:
<br />For the purposes of this section, the definitions listed
<br />below shall be construed as follows:
<br />a. CITY shall mean the City of Ramsey, Anoka County,
<br />Minnesota.
<br />b. COUNCIL shall mean the City Council of the City of
<br />Ramsey.
<br />c. DEADMAN THROTTLE or SAFETY THROTTLE shall
<br />mean a device which when pressure is removed from
<br />the engine accelerator or throttle, causes the motor
<br />to disengage from the driving mechanism.
<br />d. OPERATE shall mean to ride in or on, and control the
<br />operation of a snowmobile.
<br />e. OPERATOR shall mean every person who operates,
<br />or is in actual physical control of a snowmobile.
<br />f. PERSON shall mean an individual, partnership, cor-
<br />poration, the State and its agencies and subdivisions,
<br />and any body of persons, whether incorporated or not.
<br />g. PUBLIC PROPERTY shall mean property that may be
<br />used for all of the public subject to reasonable regula-
<br />tion by a governmental body. Such property includes
<br />City parks, City parking lots and public school park-
<br />ing lots and grounds.
