PUBLIC HEARING <br />PLANNING COMMISSION <br />CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> <br />The Ramsey Planning Commission conducted a public hearing on Tuesday, May 7, 1996, at the <br />Ramsey Municipal Center, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota to hear input <br />regarding a request for a conditional use permit for a group foster care home; case of Patrick <br />McLafferty. <br /> <br />Members Present: <br /> <br />Commissioner Ben Deemer (Acting Chairperson) <br />Commissioner Paul Holland <br />Commissioner Sharon Jensen <br />Commissioner Charles LaDue <br />Commissioner Michael Terry <br />Commissioner Bradley Thomd <br /> <br />Members Absent: Chairperson David Bawden <br /> <br />Also Present: <br /> <br />City Engineer Steve Jankowski <br />Zoning Administrator Sylvia Frolik <br /> <br />CALL TO ORDER <br /> <br />Acting Chairperson Deemer called the public hearing to order at 7:55 p.m. <br /> <br />PRESENTATION <br /> <br />Zoning Administrator Frolik explained that Patrick McLafferty of 7321 154th Lane N.W. applied <br />for a conditional use permit (CUP) in February 1995 to operate a group foster home for eight <br />youth. (He currently has six youth which is allowed by State Statute.) The City Council denied <br />the permit based upon the recommendation of the Planning Commission that this constituted a <br />rezoning. Mr. McLafferty then filed a suit against the City, and the Court ruled that the City <br />should conduct another hearing and reconsider the request. The basis for this consideration should <br />be whether or not a CUP should be issued for the two additional youth at the home, and the focus <br />needs to be on the land use impact of the additional two youth to the residence. <br /> <br />CITIZEN INPUT <br /> <br />Jim Fiala, 15330 Rhinestone Street N.W. - stated he lives three doors down from the applicant. <br />He didn't understand why this was back before the City since the City Council denied the request. <br />He stated he didn't want the request approved and he spoke pretty much for the neighborhood. He <br />felt Mr. McLafferty was having a tough time handling the six youth he has. <br /> <br />City Attorney Tom Fitzpatrick explained that the request is being reconsidered because the Court <br />found the City Council was in error. This did not constitute a rezoning; this is to be considered a <br />single family home. <br /> <br />Mr. Fiala contended that, "The point is it doesn't belong there. Who's to say the next person sells <br />his house and brings in eight more kids. It doesn't belong in this area. I want to keep it a family <br />neighborhood. It's not a business neighborhood. He's running a business out of the <br />neighborhood. What's to stop it from going further?" <br /> <br />Cindy Fiala, 15330 Rhinestone Street N.W. - stated that she has never experienced any problem <br />with the boys, however, she does have concerns about the type of care they are receiving.
