ORDINANCE #91-18 <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND <br />PERMITS CHAPTER OF THE CITY CODE. <br /> <br />AN ORDINANCE AMENDING CHAPTER 7, SECTIONS 7.61 ENTITLED <br />"CHARITABLE GAMBLING" AND REPEALING SUBSECTION 7.62.13 <br />ENTITLED "USE OF BINGO PROFITS" OF THE CITY CODE OF RAMSEY, <br />MINNESOTA. <br /> <br />The City of Ramsey ordains: <br /> <br />SECTION 1. <br /> <br />AUTHORITY <br /> <br />This Ordinance is adopted pursuant to the authority granted by Minnesota Statute Chapter 349. 35 <br />et al. <br /> <br />SECTION 2. <br /> <br />AMENDMENT <br /> <br />The following subsection is added to Section 7.61: <br /> <br />7.61.08 Use of Charitable Gambling Net Profits. <br /> <br />Any licensed organization conducting lawful gambling within the City shall be <br />required to contribute ten percent (10%) of its net profits derived from lawful <br />gambling to a fund administered and regulated by the City without cost to such <br />fund. Disbursements from this fund shall be for lawful purposes as determined <br />from time to time by City Council resolution. The term "net profits" as used herein <br />shall be that definition assigned to it by Minnesota Statute {}349.213 (1991). This <br />subsection shall apply to all licensed organizations conducting lawful gambling <br />within the City, including Bingo organizations as defined and regulated by Section <br />7.62 herein. <br /> <br />Subdivision 7.61.04(f) is amended to read as follows: <br /> <br />7.61.04(f) <br /> <br />A lease agreement between a licensed organization and a gambling location <br />owner or operator shall not provide for rental payments based on a <br />percentage of receipts or profits from lawful gambling. There shall be no <br />other compensation paid to the gambling location owner or operator, <br />directly or indirectly, other than the rental fee provided in the lease <br />agreement. The maximum rental fee shall be as prescribed by State Statute. <br /> <br />Subsection 7.61.07 is amended to read as follows: <br /> <br />7,61.07 Fee Upon application, the City will charge all new applicants an investigation <br /> fee to cover costs incurred investigating the application. Any unused <br /> portion of this fee will be refunded to the applicant. This fee does not apply <br /> to applications for renewal of licenses. This fee may change from time to <br /> time as determined by resolution of the City Council. <br /> <br /> <br />
