NOW, THEREFORE, it is mutually stipulated and a~eed: I. PURPOSE The County and the City have joined together for the purpose of constructing the roadway, drainage, and sidewalk, as well as other utilities, on a new alignment to be known as Industry Boulevard as described in the Exhibit which is attached hereto and incorporated as part of this Agreement. METHOD The County shall provide all engineering services and shall cause the construction of Anoka County Project 95-05-116 in conformance with said plans and specifications which shall be reviewed and approved by the City Engineer prior to calling for bids. The calling for all bids and the acceptance of all bid proposals shall be done by the County. The County shall cause the construction of this project and the City shall reimburse the County for its share of the costs. The County shall acquire all permits required for the construction of this project. The City shall acquire 120 feet of right-of-way plus all temporary easements necessary for the construction of Industry Boulevard on an alignment acceptable to the County. The City shall convey the right-of-way to the County. The City shall limit access to the proposed Industry Boulevard between County Road 56 (Ramsey Boulevard) and County Road 83 (Armstrong Boulevard) to six (6) access locations. For the purpose of this provision, a cross street will constitute two (2) access locations, one on each side of Industry Boulevard. The City shall indemnify and hold harmless (including attorney fees) the County from any and all damages that the County may incur as a result of the limiting of access to Industry Boulevard as provided herein.
