Subdivision 1. Purpose. The purpose of conditional rezoning is to formalize <br />development standards to ensure consistency and compatibility with surrounding land uses and' <br />neighborhoods. <br /> <br /> Subd. 2. Procedure. The procedure for chancing zoning district boundaries <br />(rezoning) shall be as follows: <br /> <br />Execution of a Conditional Rezoning Agreement ("CRA") recorded with <br />the subject property shall be compulsory for all rezonings to multiple family <br />commercial, and/or industrial districts, includim, the following: <br /> <br />R-2 Medium Density Residential District <br />R-3 High Density Residential District <br />B-I General Business District <br />B-2 Highway Business Distict <br />E- 1 Employment District <br />E-2 Employment District <br />P Public Facilities District <br />PUD Planned Unit Development District <br /> <br />Subd. 3. Standards: The followin~ shall be included in the CRA: <br /> <br />Agreement to layout, develop and maintain the subject property as <br />presented in the accompanying preliminary plat or site plan. <br /> <br />Provision to allow the City Council to commence rezoning of the <br />subject property to the previous zonin~ district if the preliminary plat <br />or site plan is not adhered to. Said zoning change shall not be <br />contested by the subject property owner or parties to CRA. <br /> <br />Additional standards may be included to protect the health, safety, <br />and general welfare ofsurroundina land uses. <br /> <br /> Subd. 3. Modifications. A~._y modification or revision to the CRA or attached <br />plan shall be prohibited without consent of the City Council. Any substantial modification as <br />determined by the City Council shall b'e subject to a public hearinq and notification of adjacent <br />property owners pursuant to the public hearing requirements of this Chapter. <br /> <br />9.03.054 Conditional Use Permits <br /> <br /> Subdivision 1. Purpose. The purpose of this Section is to provide the City <br />with a reasonable degree of discretion in determining the suitability of certain designated us. es <br />upon the general welfare, public health, and safety. A conditional use is a use which, because of <br />certain characteristics, cannot be properly classified as a permitted use in the zoning district <br />within which it is proposed.
