Case #13:

Request for an Extension to Implement the Conditional Use Permit for a
Recycling Facility for Metals and Landscape Timbers; Case of St. Paul
Terminals, Inc.

Community Development Director Frolik stated that On June 26, 2001, the City issued a
conditional use permit to St. Paul Terminals to operate a recycling processing facility for metals
and landscape timbers at 14050 Basalt Street. NW (site formerly occupied by Danny's
Aluminum Processing, Inc.). City Code states that the applicant has one year to initiate the
conditional use permit unless they request and receive an extension. The extension must be
reviewed by the Planning Commission and City Council. St. Paul Terminals did not initiate their
conditional use permit by June 26, 2002. On March 20, 2002, the City received a written request
from Bradley J. Martinson, legal representative for St. Paul Terminals, requesting an extension to
initiate the conditional use permit. The stated reason for the delay in initiating the use is
economic conditions in the recycling industry. The City Council granted St. Paul Terminals a
one year extension to complete their conditional use permit by June 26, 2003. On April 30,
2003, the City received a letter from Bradley J. Martinson, legal representative for St. Paul
Terminals, stating that St. Paul Terminals will be open for business on a limited basis but it is not
likely that they will be able to completely implement the conditions of the conditional use permit
prior to June 26, 2003. Consequently, St. Paul Terminals is requesting another extension of the
conditional use permit. As mentioned earlier, a request for extension must be reviewed by the
Planning Commission and City Council. Unfortunately, Staff did make an error in scheduling
and the request for extension has not been reviewed by the Planning Commission. The request is
proposed to be on the July agenda for the Planning Commission. The current extension expires
on June 26; the soonest City Council can take action on the request is July 15. Staff
recommended that City Council grant a 21 day administrative extension to the conditional use
permit to allow the Planning Commission the opportunity to consider the request and make a
recommendation to City Council.

Motion by Councilmember Elvig, seconded by Councilmember Kurak, to grant a 21 day
extension to July 17, 2003 relating to the conditional use permit issued to St. Paul Terminals for
a recycling facility.

Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Elvig, Kurak, Cook, Pearson,
and Zimmerman. Voting No: None.

Case #14:

Consider Authorization of Utility Easement Compensation with the City of
Anoka Utilities

City Administrator Norman stated that the cities of Anoka and Ramsey entered into a right of
entry agreement on July 11, 1995, whereby Ramsey granted Anoka access to its parcels for
construction of the electrical utility line. The agreement described the specific Ramsey parcels
and permitted Anoka to commence construction immediately, but it did not provide for payment
of Ramsey's damages. Negotiations have continued for close to eight years. On May 22, 2003,
the City Administrator of Ramsey and City Manager of Anoka met in a negotiation session with

City Council/June 10, 2003
