Ordinance No. 00-01 <br /> <br />An Ordinance relating to the operation of certain aircraft within the airspace over the City of Ham <br />Lake, Minnesota, amending Article 9 of the Ham Lake City Code; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HAM LAKE, ANOKA <br />COUNTY, MINNESOTA, AS FOLLOWS: <br /> <br />There is hereby added to the Ham Lake City Code an addition to the Definitions section of Article <br />9, to be labeled as Article 9-130.34: <br /> <br />9-130.34 Regulated Aircraft <br /> <br />Regulated Aircraft include all aircraft which are regulated by the Federal Aviation Administration <br />or the Minnesota Department of Aeronautics, and which require an operator licensed by one of <br />those two bodies in order to legally operate in the airspace in the State of Minnesota. <br /> <br />There is hereby added to the Ham Lake City Code an Article 9-470, to read as follows: <br /> <br />9-470 Operation of Regulated Aircraft <br /> <br />It shall be unlawful for any person operating a Regulated Aircraft to take off from or land u_pon any <br />land in the City of Ham Lake except as provided herein. <br /> <br />9-470.1 R-l; R-M; R-2; ML PUD; PUD; RS-1 and RS-2 Zoning Districts <br /> <br />Regulated Aircraft are prohibited from landing or taking off in the R- 1, R-2, R-M, ML-PUD, PUD, <br />RS-l, and RS-2 zoning districts, and such lands are not eligible to allow such activity by <br />conditional use permit, provided, that if such activity is proposed in a portion of a PUD or ML- <br />PUD zoning district which is located on a contiguous parcel of land of twenty or more acres in size, <br />the usage may occur by conditional use permit or temporary conditional use permit under the same <br />conditions as are imposed'by Article 9-470.3. <br /> <br />9-470.2 R-A and C-A Zoning Districts <br /> <br />Regulated Aircraft may land or take off in the R-A ~ Zoning Districts only if the following <br />conditions are met: <br /> <br />a) The operator has the permission of the landowner; <br /> <br />b) At no time may any Regulated Aircraft pass, either in flight or while taxiing, within 500 feet of <br />any occupied building, excepting a single building used exclusively for storage of the Regulated <br />Aircraft; <br /> <br /> <br />
