PROHIBITION <br /> <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning <br />and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use pern-fits <br />or variances of any kind shall be permitted, except that applications, for interim use permits for <br />which no permanent or temporary building is required may be considered. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in ~ts <br />opinion, undue hardskip or a practical difficulty may result from strict compliance. In granting <br />an exception, the City Council shall prescribe any conditions that it deems necessary to or <br />desirable, for the protection of the public interest. NO exception shall be granted unless the City' <br />Council finds: <br /> <br />That there are special circumstances or conditions affecting said property-such that the <br />Strict application of the provisions of this Moratorium Ordinance would depr/ve the <br />petitioner of the reasonable use of petitioner's land. <br /> <br />That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />That the ganting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />-304- <br /> <br /> <br />
