An area where groundwater is contaminated or lies within the
path of the migration of contaminated groundwater.

9.14.07 Required Buffer Area and Screening for Landfill Sites. The distance
between an operational landfill and other land uses is critical in avoiding scenic blight,
land use compatibility, reduction of land values and nuisances from odor, dust, noise,
vibration, etc. Therefore, the following standards shall guide the review and issuance of
conditional use permits.

Subdivision 1. Suitable buffer areas, berms, barriers and vegetation shall
be provided to minimize noise, odors, landfill gas migration, public safety, nuisances and
other impacts on adjacent properties.

Subd. 2. Suitable berms, barriers and vegetation shall screen the landfill
activity area year 'round from. property within one (1) mile of the landfill site. Solid
waste may not be used as berming material. Screening shall provide a minimum of
ninety percent (90%) opacity year round.

9.14.08 Height Limitation on Landfill Activity. The height of a landfill
becomes a scenic blight and nuisance when the landfill activity rises above any natural or
man made screening. Therefore, landfills may not exceed the height of the lowest berm,
barrier or vegetation surrounding the landfill site.

9.14.09 Required Practices for Maintenance and Operation and Landfills.
Solid waste landfills shall be operated and maintained in accordance with the rules
promulgated by the commissioner of the MPCA and in compliance with Section V of
Anoka County Ordinance 83-3 as may be amended from time to time except as modified
or amended herein.

Subdivision 1.
