Enclosed is a proposed <br />draft for Lonnie Menard. <br /> <br />My two comments are that the-section provides little or no guidance on the permissible <br />uses of accessory structures, leaving an impermissible level of. discretion in the hands of <br />city officials, and giving rise to the likelihood that the counsel issues permits on an <br />inconsistent basis. Second, the code doesn't address Lonnie Menard's concerns or his <br />situation, despite the fact that he is the applicant. Menard's objective is to expand the <br />potential home occupation uses for a large parcel in excess of ten acres, in a Iow density <br />residential district with topography and soil conditions not conducive to the current <br />zoning classification for high-density single family residential structures., in an area <br />already in use for commercial and residential purposes, adjacent to property in Burns <br />Township where parcels are of a similar size, and are subject to a less restrictive home <br />occupation ordinance. The revised ordinance we received today still focuses on limiting <br />the uses of smaller parcels, and seems unnecessarily restrictive for the uses for larger <br />parcels. The proposal is overly broad in that it applies broader uses to a small parcel of <br />one acre or more, and yet is not broad enough to expand the uses of a ten acre parcel <br />with an accessory structure already built in neighborhoods such as Menard's. <br /> <br />Since the matter is being considered based on Mr. Menard's request, it seems <br />appropriate that his proposed ordinance is heard and considered. If that requires <br />moving the hearing to the next adgenda, that is preferable than considering a proposal <br />on his behalf which does not address his needs. <br /> <br /> 2705 BUNKER LAKE BLVD.
