Chairperson Nixt closed the regular portion of the Board of Adjustments meeting at 7:10 p.m. in
order to call the public heating to order.

Public Hearing

Jackie Bell, 17110 Tiger Street, stated she is Mr. Letendre's daughter. She indicated she and her
husband would like to buy three acres of her father's property and build their home on it.

Chairperson Nixt clarified they have 290 feet of frontage and need 400 feet, so one of the lots will
have only 90 feet of frontage. He questioned why they would not make the remaining large parcel,
which is likely to be further split in the future, the non-conforming lot, thereby increasing the
possibility that the non-conforming situation will be eliminated when further development is done
to the remaining 14 acres.

Community Development Director Frolik stated she spoke with the applicant and he preferred to
retain the 200 feet of frontage for his own homestead.

Robert Tomaszewski, property owner north of the proposed lot, asked if anyone from the Board of
Adjustment had the opportunity to inspect the lot and see what affect this split and subsequent
building would have on the neighbors. He stated his concern is the proposed lot is the lowest
runoff point for the property and those behind it. He noted Mr. Bell has dug a tunnel under his
driveway to drain the water already. He is concerned that building here would flood his back yard
and walkout patio. He indicated his second point is that every time the City grants a -~ariance, they
are lowering the standards. He would recommend they maintain the standards and not cut a deal.
He does not want to see 90-foot lots ali along the street.

Chairperson Nixt stated the construction of this lot cannot increase the runoff to Mr. Tomocheski's
yard.

Mr. Tomaszewski stated there is a natural runoff that goes right where this driveway would be. If
they were to build there, they would need to build an elevated driveway.

Motion by Chairperson Nixt, seconded by Board Member Johnson to close the public hearing.

Motion carried. Voting Yes: Chairperson Nixt, Board Members Johnson, Brauer, Shepherd,
Van Scoy and Watson. Voting No: None. Absent: Board Member Reeve.

The public hearing was closed at 7:17 p.m.

Board Member Johnson asked what Mrs. Bell's response was to the points raised.

Mrs. Bell indicated her father would be more capable of answering those questions, and he is out
of town. She was not aware of the runoff situation and did not think it would be a problem.

8

Board of Adjustment/June 5, 2003
