-30- <br /> <br />Commission Business <br /> <br />chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:08 <br /> <br />Commissioner Sweet stated that the site is currently a mess and trees are currently being moved <br />and inquired as to what was taking place. <br /> <br />Commissioner Weld noted that staff has asked that the developer to provide a tree preservation <br />plan. <br /> <br />Commissioner Reeve inquired if staff has had any discussions with the applicant regarding the <br />City staff letter. <br /> <br />Community Development Assistant Wald replied yes, noting that the applicant has agreed' to do <br />everything included in the letter. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Reeve, to table action until alSer <br />Case #10 to give the applicant time to be present for the discussions. <br /> <br />Motion Carried. Voting Yes: Chairperson NLxt, Commissioners Johnson, Reeve, Kociscak, <br />Sweet, and Wivoda. Voting No: None. <br /> <br />Case #7: <br /> <br />Request for Preliminary Plat Approval of The Ponds; Case of Royal Oaks <br />Realty <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8: I 1 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 8: I 1 p.m. <br /> <br />Presentation <br /> <br />Principal Planner Tmdgeon stated that Royal Oaks Realty has submitted a preliminary plat <br />showing the development of 86.71 acres at the comer of Dysprosium St. and Nowthen <br />Boulevard. Royal Oaks Realty is proposing to develop 73 single-family lots, 152 townhome units <br />and 82 apartment units on this property. As part of this plat, the applicant is also asking to rezone <br />the property to Planned Un/t Development (P.U.D.), to receive a variance from the height <br />restrictions for the proposed apartment building, and site plan approvals of the townhouse <br />development and apartment building. The property is currently zoned R-1 Single Family and B-1 <br />Business. The applicant is asking for a rezoning of the property to P.U.D. The M'arch 2001 Draft <br />Comprehensive Plan shows a total of 7.52 acres of this 'property being High Density Residential, <br /> <br />Planning Commission/June 5, 2001 <br /> Page 8 of 28 <br /> <br /> <br />
