Mayor Gamec stated that he thought the proposed development looked great.

Mr. Peterson stated that he would be shocked if they had any strong objection from any of the
neighbors.

Councilmember Anderson inquired if the property owners will have an option as to what trees
will stay and what will be removed.

Mr. Peterson replied that they are planning having the lots be custom graded to minimize the tree
loss.

Councilmember Kurak stated that she appreciated Mr. Peterson's efforts as a developer in the
City and ,,vorking with neighbors, saving the trees, and'-willingness to apply restricted covenants
on those buffering trees.

Councilmember Zimmerman stated that they needed to let the development go through the
process and not give an opinion until the public hearing has .been held.

2) Plants and Things

City Administrator Norman stated that he had spoken with the Council during a work session in
July regarding a development plan for the Plants and Things site. Staff has received a response
from the owners of Plants and Things that they are not willihg to make a commitment at this
time. Staff has a lack of trust with working with Mr. Hickman because of past instances. The
concern staff has is that Mr. Hickman has no plans and that the existing buildings will remain.
Staff has discussed the issue of placing the property within the proposed moratorium with the
City Attorney and the Attorney has indicated that placing the property in a moratorium is enough
action to stop future development plans without 'the City having to start condemnation action.

Mayor Gamec stated that that comer has been a problem for along time.

Councilmember Zimmerman stated that something has to be done with Highway #10 in the near
future because they have no secondary road to back up Highway # 10.

Councilmember Hendriksen stated that there has been a long history of br°ken promises on the
- Plants and Things property. His concern is that any commitment that might be made they have
to view with a certain amount of skepticism. He felt that the moratorium was the way to
proceed.

City Council/October 15, 2002

27
