-2- <br /> <br />DRAFT DEVELOPMENT AGREEMENT BIRCH HILL LODGES <br /> <br />Park Dedication <br /> <br />Park Dedication shall consist of the dedication of 1.05 acre in the southwest comer of the plat to <br />the CITY. The balance of Park Dedication shall consist of a cash payment of $27,300. <br /> <br />In addition to the dedication of land and the cash payment, the CITY the DEVELOPER shall <br />cooperate on the following Stage 1 improvements: <br /> <br />Clearing and grading of the site as well as establishment of turf is the responsibility of the <br />DEVELOPER. <br /> <br />The DEVELOPER shall.propose a playfield backstop design including installation costs <br />to the CITY. The approved improvement cost shall be deducted from the cash park <br />dedication due above. <br /> <br />The playfield shall be graded level with a maximum gradient of 2% in any direction. The <br />preferred design would be for the center to be the high point with a 1% slope extending <br />northwesterly and southeasterly, from a line drawn between "home plate" and the <br />outfield beyond "second base". <br /> <br />The DEVELOPER shall relocate by tree spade, a minimum of 40 scotch pines prior to, or <br />concmTent with, the clearing and grubbing operation. At least 15 Scotch pine trees shall <br />be located within the existing Solstice Park or the additional park space being dedicated. <br />The CITY shall be responsible for mulching and watering any park trees. <br /> <br />The DEVELOPER shall install groupings of River birch and Quaking aspen along the <br />bituminous trail to be constructed in the existing and expanded Solstice Park. The <br />approved park landscaping shall be eligible for credit against the cash Park Dedication <br />due. The CITY shall be responsible for watering the trees after the initial mulching and <br />watering at the time of installation. <br /> <br />A 6" watermain shall be stubbed out and plugged, 8' feet into the east boundary of the <br />park by the DEVELOPER. This alignment shall be generally in the center of the park <br />and terminate with a hydrant. <br /> <br />Trail Fees <br /> <br />The Trail Fee due is $27,300 ($325 x 84 units). The DEVELOPER shall construct an 8' <br />biturnlnous trail from the existing trail in Solstice Park, easterly and parallel with the south line <br />of the existing and new parkland, and connect to Cobalt Street. The completed trail shall be <br />eligible for a credit of $10 per lineal foot against the trail fees above. <br /> <br />The trail must not exceed 5% in grade and shall meet a depressed curb section at Cobalt Street. <br />The trail should be 6' south of the back of the curb at the private driveway of Lot 1, Blpck 2 to <br />provide for snow storage. <br /> <br />Sidewalk <br /> <br />An ADA compliant sidewalk shall be constructed on the east side of Cobalt Street and terminate <br />across from the bituminous trail. <br />P & R: 12/13/01 <br /> <br /> <br />
