Motion by Commissioner LaDue and seconded by Commissioner Thorud to amend #18 to read <br />"That the proposed use will not adversely impact traffic in the area." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Thorud, Deemer, <br />Hendriksen, and Terry. Voting No: None. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend #19 through <br />#27 in the affirmative. <br /> <br />Further Discussion: Commissioner Deemer stated that the operation has been going on for 14 <br />years and is not going to change substantially. Commissioner Hendriksen stated he didn't feel all <br />of the items should be in the aff'mnative. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Terry, and <br />Thorud. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that City <br />Council adopt the amended Findings of Fact relating to Commercial Asphalt's request for a <br />conditional use permit for a hot mix asphalt plant. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Terry, and <br />Thorud. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. <br /> <br />The Planning Commission proceeded to review the terms of the CUP. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend #4 to read <br />"That any stock piles of material shall be limited to a maximum height of 35 feet as measured from <br />the existing ground elevation over which it is placed and shall be located no closer than 20 feet to <br />any property boundary." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Hendriksen, <br />Terry, and Thomd. Voting No: None. Absent: Commissioner Holland. <br /> <br />Commissioner Hendriksen felt the Commission should put in a term requiring that the odor <br />problem be addressed if brought to the permit holder's attention. <br /> <br />Chairperson Bawden noted that the CUP requires compliance with the MPCA standards, and <br />beyond that, odors are difficult to enforce because it is such a subjective issue. <br /> <br />Commissioner Deemer suggested putting in a condition that requires the permit holder to crush at <br />least once a year thereby promoting usage of the recycled product. He felt this would reduce the <br />volume taken in and at the same time encourage disposal of it. <br /> <br />The applicant agreed that this would not pose a problem as they are already crushing at least once a <br />year. <br /> <br />Consensus of the Commission was to direct Staff to add a term requiring a minimum crushing of <br />once a year similar to that placed on the Bury & Carlson CUP. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council approve the issuance of a conditional use permit to Commercial Asphalt for a hot mix <br />asphalt plant and adopt Resolution g95-02-~ declaring terms of same, as amended. <br /> <br />Planning Commission/February 7, 1995 <br /> Page 7 of 11 <br /> <br /> <br />
