Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, LaDue, and
Thorud. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland.

Case #6: Request for Preliminary Plat Approval of Willow Ridge; Case of
Gary Gorham

Zoning Administrator Frolik advised that Gary Gorham is requesting preliminary plat approval of
Willow Ridge located on the east side of Highway #47 at about 149th Avenue. The plat consists
of 18 acres proposed to be platted into 35 single family residential lots served by municipal water
and sanitary sewer.

Applicant Gary Gorham addressed the drainage concerns raised at the public hearing on this
matter. He explained that the positive overflow will be to the north of this development which
should help alleviate the problem area discussed which is south of the plat. He encouraged reliance
on the regulatory agencies involved that advise in these matters. Referencing the possible
elimination of access to Highway #47 at 152nd, he stressed the need to address the safety issue
involved.

The Planning Commission discussed the drainage concerns of the resident who spoke at the public
hearing on this matter.

Commissioner Deemer suggested monitoring the Ordinary High Water (OHW) to address this.

Commissioner Hendriksen stated that land is being converted from a more useable grade of
wetland to a less useable wetland, and he f'mds this inappropriate.

Commissioner Deemer replied that it has been documented that part of this residenfs land is below
the OHW, and there is nothing that can be done about it.

The Planning Commission directed City Engineer Jankowski to research whether the drainage
system outfall from the wetland system constructed as a part of the Amber Ridge subdivision is
functioning properly.

Motion by Commissioner LaDue and seconded by Commissioner Deemer to recommend that City
Council grant preliminary plat approval to Willow Ridge subject to City Staff Review letter of
February 1, 1995.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Hendriksen,
Terry, and Thorud. Voting No: None. Absent: Commissioner Holland.

Case g'/: Request to Rezone Certain Property from R.3 Urban Residential to
R-1 Urban Residential; Case of Gary Gorham

Zoning Administrator Frolik advised that the subject property (proposed plat of Willow Ridge) is
currently zoned R-3 Urban Residential for multi-family units. As Gary Gotham is in the process
of platting Willow Ridge to be developed in its entirety with single family homes, rezoning the
property to R-1 Urban Residential is required.

The Planning Commission proceeded to review the Findings of Fact.

Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend #8 and g9 in
the affirmative and recommend that City Council adopt the amended Findings of Fact relating to a
request from Gary Gotham to rezone certain property from R-3 Urban Residential to R-1 Urban
Residential.

Planning Commission/February 7, 1995
