Further Discussion: Commissioner Deemer specifically requested an exhibit detailing where the <br />districts are located. Commissioner Hendriksen felt that these laws are becoming more and more <br />elusive and that more and more is being taken from property owners. Mr. Jankowski indicated <br />that the proposed increase in height restriction is to allow for the construction of the more upscale <br />two and three story homes. The intent of the impervious surface area restriction was also <br />discussed. Mr. Jankowski agreed that the purpose of the District is an admirable one but it has to <br />make sense, and these changes were an attempt to do so. Commissioner Hendriksen expressed a <br />need to balance what the affect is and at what cost, explaining that there is becoming significantly <br />greater impact on land owners and their property rights are being taken away in an arbitrary way. <br />Commissioner Deemer also expressed concern that there were no references (for the lay person) as <br />to which overlay district applies to which river. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, LaDue, and Terry. Voting No: None. Absent: Commissioner Thomd. <br /> <br />Case #6: Monthly Status Report <br /> <br />Commissioner Deemer noted that Rebecca Jackson's request for a CUP for an accessory apartment <br />is pending (since 7/5/94) on the ordinance which is being forwarded to City Council with a <br />negative recommendation. <br /> <br />Chairperson Bawden inquired about whether Staff has researched the Amber Ridge drainage <br />system (pending since 2/'7/95). <br /> <br />City Engineer Jankowski replied that it has been found to be functioning, however when the water <br />level is only slightly higher than the Ordinary High Water, the flow out of the overflow is quite <br />low and it takes a long time to drain down the last couple of inches. Mr. Jankowski suggests the <br />overflow be modified with either an arch pipe or a weir. <br /> <br />Chairperson Bawden asked if this addresses the concern of the resident at the public hearing. <br /> <br />Mr. Jankowski stated that the development of Amber Ridge provided for ponding which improved <br />this resident's problem, however, since that time the ground water has risen. <br /> <br />Commissioner Hendriksen referenced the pending direction from 2/7/95 regarding Northfork <br />Moors plat's omission of a portion of the trail corridor, and he stated that Dennis Peck has advised <br />him that this stub of trail corridor has been added to the plat. <br /> <br />Case g'/: Zoning Bulletin and Zoning News <br /> <br />This information was noted. <br /> <br />COMMISSION INPUT <br /> <br />Commission Hendriksen referred to Planning Commission meeting minutes dated February 7, <br />1995, page M16 of the agenda, paragraph 5, and stated that he did not recall Chairperson Bawden <br />and Commissioner Deemer agreeing with Commissioner LaDue's assessment that he was out of <br />order.
