NOTE CITY COUNCIL MEETING MINUTES

The Planning Commission noted the following City Council meeting minutes:

1) City Council public hearing and regular meeting minutes dated February 14, 1995.

2) City Council regular meeting minutes dated February 28, 1995.

3) City Council regular meeting minutes dated March 14, 1995.

PUBLIC HEARINGS

Chairperson Bawden adjourned the regular Planning Commission meeting at 7:35 p.m. in order to
conduct the following public hearings:

1)

Request for a Conditional Use Permit for a Group Foster Care Home; Case of Patrick
McLafferty (reconvening)

2)

Request to Rezone Certain Property from B-1 Business to B-2 Business; Case of Polka
Dot Dairy and Wayne Johnson, Rum River Properties

3) Request to Rezone Certain Property from B-3 Highway Business to R-1 Urban
Residential; Case of Super Bowl, Inc. and Fitzsimonds Builders, Inc.

4)

Request for Preliminary Plat Approval of Fox Knoll; Case of Rick Murray, Residential
Development Company, and Mark Kleckner, Fox Development Co.

Chairperson Bawden called the regular Planning Commission meeting back to order at 8:50 p.m.

COMMISSION BUSINESS

Case #1: Request for Conditional Use Permit for a Group Foster Care Home;
Case of Patrick McLafferty

Zoning Administrator Frolik recounted that when the March Planning Commission meeting was
called to order, Mr. McLafferty insisted that the public hearing be opened despite City Attorney
Goodrich's advice to reject the application. Hence, the Planning Commission conducted the public
hearing which was reconvened and adjourned earlier tonight. Therefore, it is Mr. Goodrich's
advice that because the public hearing was conducted, it in effect initiated the conditional use permit
(CUP) process, and based on that, he advises the Planning Commission to continue considering
this matter from a zoning perspective, adopt findings of fact, and make their recommendation to the
City Council.

Mr. Gerry Randall, of Randall, Dehn & Goodrich, suggested that the Commission consider
amending the findings of fact to reflect that permitting this use is not in harmony with the City
Comprehensive Plan.

The Planning Commission proceeded to review the findings of fact.

It was the consensus of the Planning Commission to accept gl through #10 as presented.

Planning Commission/April 4, 1995
