Motion by Commissioner LaDue and seconded by Commissioner Deemer to amend #11 to read <br />"That permitting a multi-family use in a single family residential zone is not consistent with the <br />intent and purposes of the City's Zoning Chapter, and it is not in harmony with the City's <br />Comprehensive Plan." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Holland, <br />Terry, and Thorud. Voting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend #12 to read <br />"That the City has not permitted other multi-family uses in a single family residential zone since <br />1976, and that there are no provisions in the City ordinances for multi-family uses without city <br />sewer and water." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud, Holland, <br />LaDue, and Terry. Voting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to add a finding to read <br />"That the proposed use will require additional City services by reason that there will be an increase <br />in police calls due to the nature of the use." <br /> <br />Further Discussion: Commissioner Holland stated that he heard no mention that there have been <br />any police calls to date. Commissioner Deemer replied that Mr. Cal Henderson submitted <br />information at the public hearing regarding police calls to this residence. Attorney Randall stressed <br />that there was no need for this scrutiny since this is not a CUP issue, but a rezoning issue. <br /> <br />Motion failed. Voting Yes: Commissioner Terry. Voting No: Chairperson Bawden, <br />Commissioners Deemer, Holland, LaDue, and Thorud. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner LaDue to recommend that City <br />Council adopt the amended findings of fact relating to Patrick McLafferty's request for a <br />conditional use permit for a group foster home to accommodate eight (8) youth in a single family <br />residential district. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Holland, LaDue, Deemer, <br />Terry, and Thorud. Voting No: None. Abstain: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council deny Patrick McLafferty's request for a conditional use permit based on negative findings <br />of fact. <br /> <br />Further Discussion: It was the consensus of the Planning Commission that this is a rezoning <br />issue, and therefore considered the request to be spot zoning. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, LaDue, <br />Terry, and Thorud. Voting No: None.
