Absent: Commissioners Holland and Terry. <br /> <br />Case #12: Request for Site Plan Review for a Maintenance Building at Rum <br /> River Hills Golf Course; Case of Rum River Hills, Inc. <br /> <br />Zoning Administrator Frolik advised that Rum River Hills, Inc. is requesting site plan review to <br />construct a 3,780 square foot maintenance building in the southwest comer of the Rum River Hills <br />Golf Course property. She noted that Mr. Jerry Schmidt, a neighbor to the south, has discussed <br />concerns regarding the request and Staff has been working to resolve those. <br /> <br />Gerry Schmidt, 5831 164th Lane N.W, - stated his property abuts the southwest property of the <br />golf course. <br /> <br />Ms. Frolik explained that Mr. Schmidt is concerned that the Planned Unit Development (PUD) <br />Agreement never specified that there would be a maintenance building on the site, therefore, he <br />feels there should be a public hearing on the matter. The City Attorney advises that the site plan <br />process does not require a public hearing, however, it is perfectly acceptable to hold a public <br />hearing to amend the PUD Plan to specifically allow for the development of a maintenance building <br />on the site. The current zoning of PUD is appropriate for the type of structure and use proposed to <br />be developed. <br /> <br />Mr. Schmidt stated his basic concern is that the zoning office has taken the position that a public <br />hearing is not needed, and he feels one is needed. He stated that City Code requires a rezoning of <br />the site be filed when a major change occurs to a PUD. <br /> <br />Ms. Frolik stated that the Planning Commission can go back and hold a public hearing on the <br />amendment to the PUD, and if acceptable, the site plan can be reviewed at the same time. <br /> <br />Bill Dom of Rum River Hills, Inc. stressed that this project is zoned PUD, and that the purpose of <br />that zoning is to get the land uses approved and develop the project over the years. He explained <br />that as the golf course has matured, the need for a maintenance building has arisen since they have <br />outgrown the one across T.H. #47. Mr. Dom interpreted the City Attorney's advice to be that a <br />public hearing is discretionary. Mr. Dom stated the Planning Commission should not hold a <br />public hearing every time there is a minor objection. He stated that the neighborhood was notified, <br />yet only Mr. Schmidt has attended tonight's meeting. Mr. Dom felt that a public hearing would <br />only delay this matter and would not accomplish anything. <br /> <br />Mr. Schmidt referred to the Staff Review Letter dated June 1, 1995, indicating that the site was <br />zoned and designated for a golf course, not a commercial building. He stated it was "a far stretch" <br />to take a park-type setting and put a commercial-type use in there. He stated that they will be <br />storing mowers, bobcats, gasoline, chemicals, etc. in the building, and he strongly opposed such. <br /> <br />Commissioner Hendriksen indicated that, as part of the golf course, the applicant presently is able <br />to store that equipment outside in that area if he so chooses. <br /> <br />Mr. Schmidt stated he did not consider the parking of this equipment as an activity relating to <br />golfing (an open space activity). <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to schedule a public <br />hearing for June 21, 1995 at 7:30 p.m. to consider an amendment to the development plan for the <br /> <br />Planning Commission/June 6, 1995 <br /> Page 12 of 14 <br /> <br /> <br />
