Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, and Terry. Voting No: None. Absent: Commissioners LaDue and Thorud. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Hendriksen to amend gl 1 to <br />read "That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare." <br /> <br />Motion carried. Absent: Commissioners LaDue and Thom& <br /> <br />Commissioner Holland inquired whether all houses to be built have to go before the Northfork <br />Homeowner's Association Architectural Review Committee. <br /> <br />Mr. Tincher replied yes, but he explained that they would like their recommendations noted in the <br />July 5, 1995 memorandum stated up front in the grading permit so that there would be no <br />confusion for potential buyers. <br /> <br />Chairperson Bawden didn't feel that the Planning Commission could enforce that; "City Code <br />doesn't say that a two-story can't be built on those lots." <br /> <br />Ms. Frolik agreed that these items need to be flagged by the Architectural Review Committee when <br />requests for these lots come before them. <br /> <br />Commissioner Hendriksen stated it appears that the Architectural Review Committee is asking that <br />this be significantly less than what North Fork, Inc. can build today without any permits <br />whatsoever. <br /> <br />Chairperson Bawden restated that the point is the City cannot enforce the Architectural Review <br />Committee's request because it is not in the City Code. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to add a finding to <br />read "That on June 6, 1995, the Planning Commission tabled action in order to receive further <br />input from the Homeowner's Association, and the result of that input is a memorandum from <br />Zoning Administrator Sylvia Frolik dated July 5, 1995." <br /> <br />Motion carried.
