Mr. Jankowski indicated that he attempted to consolidate accesses onto Highway #10 with adjacent <br />properties, however, it was not feasible and they each do have rights to access. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council grant site plan approval to Lano Brothers for site improvements at 6246 Highway #10 <br />N.W. based upon discussion and Staff review letter dated November 2, 1995, and contingent <br />upon supplying a financial guarantee to ensure timely completion of the project. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />Terry, and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />Case 02: <br /> <br />Request for an Amended Conditional Use Permit for a Demolition <br />Concrete and Asphalt Processing Facility; Case of Bury and Carlson, <br />Inc. <br /> <br />Zoning Administrator Frolik reported that the City of Ramsey has received a request from Bury & <br />Carlson, Inc. for two revisions to the terms of their conditional use permit: eliminating the <br />restriction of hours of operation and the requirement for weekly sweeping of Jaspar Street and <br />143rd Avenue. The Planning Commission was provided with a summary of restrictions on other <br />heavy industrial uses in Ramsey, and it was noted that the business listed had no restrictions or <br />more lenient restrictions than Bury and Carlson. City Staff recommends eliminating the permit <br />term which restricts the hours of operation. With regard to the permit term requiring the regular <br />cleaning of access roads, City Staff feels language requiring removal of debris attributable to the <br />business within 24 hours is adequate. <br /> <br />Commissioner Deemer inquired as to the retail hours on Sunday. <br /> <br />Ms. Frolik replied that Staff recommends there be no restrictions on Sunday hours. <br /> <br />Commissioner Hendriksen noted that Bury and Carlson have done a fantastic job in terms of <br />policing the site. He asserted that a lot of their product is being offered to homeowners and there is <br />a need to supply such on weekends, therefore he didn't see any reason to restrict Sunday hours. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to accept #1 through #8 <br />as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, Hendriksen, <br />Terry, and Thomd. Voting No: None. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend g9 through #13 <br />in the affirmative. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />LaDue, and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council adopt the amended Findings of Fact. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />LaDue, and Thorud. Voting No: None.
