Zoning Administrator Frolik interjected that Staff doesn't feel drainage is a concern in this case, <br />and an escrow is not required. She added, however, that a paved driveway is still a <br />recommendation of Staff, and that this driveway would have to be removed when the other street <br />comes through. <br /> <br />Commissioner Thorud inquired for the justification of a paved driveway when the hammerhead or <br />turn-around will be Class 5. <br /> <br />Commissioner Deemer explained that the applicant is asking for this variance so they don't have to <br />provide 200 feet of paved street. <br /> <br />The Board of Adjustment proceeded to review the Findings of Fact. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Thorud to approve gl through <br />//9 as presented. <br /> <br />Motion carded. Voting Yes: Chairperson Deemer, Board Members Bawden, Thorud, LaDue, and <br />Terry. Voting No: None. Absent: Board Members Hendriksen and Holland. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Thorud to amend gl0 to read <br />"That the special conditions, 33 feet of frontage on a public road, do not result from the actions of <br />the Applicant." <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Bawden, Thorud, LaI)ue, and <br />Terry. Voting No: None. Absent: Board Members Hendriksen and Holland. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Terry to amend gl 1 through <br />#17 in the affirmative. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Bawden, Terry, LaDue, and <br />Thorud. Voting No: None. Absent: Board Members Hendriksen and Holland. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Terry to adopt Resolution <br />//95-07-150 adopting Findings of Fact #0381, as amended, relating to Joel and JoDee Nelson's <br />request for a variance from the street frontage requirement. <br /> <br />Motion carded. Voting Yes: Chairperson Deemer, Board Members Bawden, Terry, LaDue, and <br />Thorud. Voting No: None. Absent: Board Members Hendriksen and Holland. <br /> <br />The Board of Adjustment proceeded to review the terms of the variance. <br /> <br />Motion by Board Member Bawden and seconded by Board Member Thorud to delete #7 regarding <br />a cash escrow requirement for drainage problems resulting from the creation of the driveway and <br />turn-around. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Bawden, Thorud, LaDue, and <br />Terry. Voting No: None. Absent: Board Members Hendriksen and Holland. <br /> <br />Motion by Board Member Thorud and seconded by Board Member Terry to amend #3 to read <br />"Only one private driveway from the Subject Property will be granted access to 173rd Avenue <br />N.W. Said driveway shall be surfaced with bituminous, concrete or Class 5 and it shall access <br />173rd at the same point at which the existing private driveway for the adjacent parcel to the north <br />does. The property owner shall also be responsible for shaping or grading a Class 5 temporary <br />turn-around in the form of a bulb or hammerhead at the western terminus of 173rd Avenue N.W. <br /> <br />Board of Adjustment/July 20, 1995 <br /> Page 2 of 3 <br /> <br /> <br />
