his word to the residents and also to the City. A year ago he had stated he was getting
plans for the house to a draftsman; no one believes him any more. Mr. Denny added "we
hate to be a pain but we will be if we have to be. 'Tm sure between A1 and the City,
something should be done". He asked that the concerned residents be updated frequently.
"We are angry. We will not settle".

Bob Adams, 5850 - 141st Lane N.W., Ramsey, stated "we are not here to lie. We were
told by builders, Realtors, and Koenig that they would be pushing it (house) in or adding
$25,000 to it. This is the second fall and he has done nothing. You would think the
developer would abide. He is not exempt from the rules. People have been calling the City
for a year and a half to get something done. You would think the City could do something6
I have been promised a lot and have not seen anything." Mr. Adams added that sometimes
there are eight to ten cars parked on the yard. He added that he quit putting money into his
own house and that one of his neighbors is trying to sell their house and they feel the
condition of Mr. Koenig's house is affecting the sale.

Mr. Denny stated that this neighborhood was established over two years ago. He felt that
some of the people would be "moving on" and this house (Koenig's) will affect the
property value.

Mr. Adams felt it would be a "different story" if they had not been told something would be
done about the house.

Mr. Denny stated "We would like action. We are prepared to file suit".

Mayor Hardin inquired of Mr. Denny when his last conversation with Mr. Koenig was.

Mr. Denny replied "about eight months ago". He let him (Koenig) know the neighbors
were concerned. Mr. Koenig had talked about how busy he was but that his wife was
working on a plan. It's been almost a year since that conversation. Mr. Denny continued
that at one point Mr. Koenig told him this was not of his business. Mr. Denny stated it is
his business, it's his home, and they have been promised something would be done about
this house. He added that he was surprised the City didn't get something in writing about
this house from Mr. Koenig.

Mayor Hardin stated he spoke with Mr. Koenig last Friday and was assured he (Koenig)
would be making some improvements this spring. He asked Mr. Koenig for a letter and a
time table; however, that had not yet been received. He added that he did not know if he
would receive a letter this week or not. Mayor Hardin stated this is the action he has taken
as a result of a phone conversation with Mr. Denny.

Mr. Denny stated if a person does not put in a hard driveway, then the City should do it
and charge the homeowner for it.

City Attorney Goodrich stated it is the responsibility of the City to ensure a hard driveway
is installed. He asked the residents if they have anything signed by Mr. Koenig, with
regard to restrictions, etc.

Mr. Denny inquired if Mr. Goodrich was questioning whether or not the list of
requirements was from Mr. Koenig. He added that the City should be able to commit right
now that it will install the driveway if Mr. Koenig does not.

Mr. Goodrich stated that Staff will see to it this is accomplished.

City Council/January 10, 1995
