Mr. Jankowski replied it has not been designated florxt plain.

Mr. Berg stated that someone built too low and the City is asking everyone in the district to
bail him out. He suggested assessing all and refunding the residents who paid to have a
storm sewer developed.

Mr. Goodrich stated that there was an ordinance adopted in 1986 that excluded certain
properties from assessments for this type of project for five years (1991).

Mr. Berg stated that the City cannot show benefit to his property in River's Bend.

Mr. Goodrich explained that individual benefit does not have to be shown under Chapter
444.

Charles Canesi, 7751 - 166th Avenue N.W., Ramsey, inquired how many homes are in
the drainage area.

Mr. Jankowski replied about 4,000.

Mr. Canesi inquired if the land that will be saved will eventually be developed.

Mr. Jankowski replied that the area is currently rural but it possibly could be developed in
the future.

Mr. Canesi suggested levying a tax on the developer and leaving the citizens alone. He
commented that maybe the residents should have a Boston Tea Party; enough is enough.
He inquired if a permit was given for the pond.

Mr. Jankowski stated he did not believe a permit had been issued for the pond.

Mr. Canesi suggested taking the pond out.

Mr. Jankowski stated that this is a natural low area. The City has no reason to dictate what
the owner could do with his land.

Mr. Canesi inquired if it was built in the line of the ancient ditch.

Mr. Jankowski replied yes.

Mr. Canesi stated that the City is at fault. He stated that if the person put the pond in
without the City's knowledge, they should be fined.

Mr. Schroeder stated that there is a natural drainage way. The City of Ramsey does not
have a right to be on that property. We do not own an easement to ensure the drainage
goes anywhere. Part of this project is to gain a right to a utility and drainage easement.

Mr. Canesi inquired who built the drainage way.

Mr. Jankowski replied County Ditch//3 was constructed by the County in 1890 - they have
legal rights to that land. We do not know who constructed the lateral ditch - presumably
the land owner.

Mr. Canesi inquired if there is a potential of homes being built there.

City Council/March 14, 1995
