Steffen. This was not an attempt to get anything free from Attorney Goodrich. Mr.
Hendriksen stated he was trying to be cooperative and somehow the whole issue has
snowballed into something it was not intended to be. He reiterated that he honestly thought
it was an offer.

Mr. Goodrich responded that it is an offer as long as the City Council or City Staff wants
him to review it.

Mr. Hendriksen felt that it should be reviewed by Mr. Goodrich. He added that he has
obtained his own legal counsel so he knows this amendment is constitutional.

Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to refer
the proposed charter amendment to the Charter Commission.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer
and Peterson. Voting No: None.

Case # 14: Option Agreement Approval

City Administrator Schroeder stated that the City will be constructing sanitary sewer and
water lines out to the Anoka Electric Cooperative (AEC) facility during the summer 1995.
This extension of utility lines will require the acquisition of easements across certain
properties located along the Burlington Northern Rail lines. It is intended that this
construction will coincide with the placement of the new electric line for the Anoka Electric
Utility and the combination of the existing AEC transmission lines. Mr. Greenberg, the
owner of the parcel abutting Sunfish Lake Boulevard, has indicated that the entire 6.5-acre
parcel could be acquired for $20,000 plus back taxes (estimated at $13,848.04) or $5,207
per acre. The owner has also stated that the payment could be delayed until a future date.
The proposed option agreement indicates a September 1, 1995 payment, with the property
transfer occurring within 60 days. He explained that the City will need to acquire an
estimated 1.8 acres for the utility/roadway easements to extend the lines across the property
and to gain an 80' McKinley Street right-of-way. In addition, the City would gain clear
title to Azurite Street as a portion of a land purchase. The estimated purchase price of
McKinley/Utility acquisition is $6,300 plus costs. Mr. Schroeder suggested this fee
purchase of the property represents an excellent value given its location expenditures for
accessory easements and Anoka Municipal Utility future easements.

Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to
authorize option/purchase agreements for the parcel abutting Sunfish Lake Boulevard and
the 1.8 acres for the utility/roadway easements to extend the lines across the property and to
gain an 80' McKinley Street right-of-way.

Further discussion: Mayor Hardin inquired of Mr. Schroeder how difficult he felt it would
be to resell the property. Mr. Schroeder replied that we have one lot spoken for but that
this is a more difficult piece to sell. Mayor Hardin expressed a concern about that and
inquired about soil testing. Mr. Schroeder stated that the testing is a part of the clear title.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer
and Peterson. Voting No: None.

Case #15: Report from Fire Board

City Administrator Schroeder presented a report from the Fire Board. The Board received
an update on a drug and alcohol policy and Staff will be working on a City-wide policy for

City Council/April 25, 1995
