policy. Mr. Boos stated that these things have been negotiated. Councilmember Beyer felt <br />that this seems to be forced upon the developers. Zoning Administrator Frolik commented <br />that the reference is to a policy adopted by the Park and Recreation Commission. <br />Councilmember Beyer stated that Council adopts policies, not the Park and Recreation <br />Commission. Mr. Schroeder added that the Park and Recreation Commission has made <br />recommendations or given direction on a particular plat and it is forwarded as a part of the <br />development agreement that is reviewed by Council. It is on the agenda tonight because <br />almost every Councilmember has said they do not remember voting on it. Council has also <br />said "let's talk with the developers" - that has happened. Another meeting with developers <br />will occur. What Mr. Boos is presenting are the items that are not controversial. If City <br />Council has no problem with these and the developers do not, we are asking that you ratify <br />this policy. Councilmember Zimmerman stated it would be perceived by the developers as <br />if we are passing something before they have a chance to meet on it again. <br /> <br />Motion carded. Voting No: None. <br /> <br />Case #11: Proposed Charter Amendment <br /> <br />City Administrator Schroeder stated that at the April 11, 1995 meeting, there was a request <br />by Ramsey resident Steve Croteau to have Council consider a moratorium on urban <br />development. Council has not taken action upon this request. It is Staff's belief that <br />requests for expenditure of Staff and Attorney time will be forthcoming on this issue. He <br />requested Council direction on whether or not the City Attorney should be available upon <br />request for review of format and constitutionality issues, or only upon specific Council <br />directive. <br /> <br />Councilmember Beyer stated she was under the impression that City Attorney Goodrich <br />was to give his opinion on whether Council could vote on the moratorium or not. <br /> <br />Mayor Hardin stated that Mr. Goodrich had given his opinion that night at the meeting. He <br />(Hardin) stated that items have gone to different commissions for discussion, and perhaps <br />this one should go to the Charter Commission. <br /> <br />Councilmember Peterson stated he is not in favor of offering legal counsel to the residents. <br /> <br />City Attorney Goodrich stated he had said an attorney should review the request. In <br />response to that, he received a request to review a charter amendment. The issue is, should <br />the citizen direct me. <br /> <br />Mayor Hardin stated we should not be giving carte blanche to someone to have the City <br />Attorney spending hours reviewing this. It should be brought to the Charter Commission. <br /> <br />Councilmember Zimmerman stated he has been hearing that Staff is not too cooperative. <br />We need to direct them to see this process through and maybe it should be reviewed by the <br />Charter Commission. <br /> <br />Attorney Goodrich stated that the person who submitted the request should take it to the <br />Charter Commission. <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard N.W., Ramsey, stated he thought he heard <br />the City Attorney offer to review the proposed charter amendment. He acted on what he <br />believed to be an offer; he submitted the proposed amendment for the City Attorney's <br />review.
