City Administrator Schroeder stated that earlier this evening, Council gave final approval to the Ramsey Business 95 subdivision. This subdivision was created for the proposed facilities that the City Council gave tentative approval to at the March 28, 1995 Council meeting. In conjunction with these proposed developments, the City will need to sell the properties to prospective firrns for their site development. Our Charter currently requires that an ordinance is passed prior to sale of any City-owned property. Such ordinance is before you for introduction. Motion by Councilmember Peterson and seconded by Councilmember Beahen to introduce an ordinance authorizing sale of Lot 1, Block 1, Ramsey Business Park 95, Lot 1, Block 2, Ramsey Business park and Lot 2, Block 2, Ramsey Business Park 95. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peters#n, Beahen, Beyer and Zimmerman. Voting No: None. Case #12: North Metro Mayors Membership City Administrator Schroeder reminded Council that at the last meeting, Mr. Elwyn Tinklenberg, Mayor of Blaine, was present to request Ramsey membership in the North Metro Mayors Association (NMMA). If Council determines to join the NMMA, it would require an allocation from contingency of $3,565. Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to adopt Resolution g95-04-082 amending budget and allocating $3,565 to join the North Metro Mayors Association. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Zimmerman, Beahen and Peterson. Voting No: None. Case 010: Tree Conservation Policy Process Parks/Utilities Supervisor Boos explained that the purpose of this case is to receive Council aff'mnation and direction on the interim tree conservation policy process. This subject has been addressed by the City Council, Park and Recreation Commission, and frequent developers in the City of Ramsey. Tree issues continue to be sorted out due to mutual agreement between the Commissions, City Staff, and developers. City Council then has approved the terms via the development agreement. Mr. Boos listed the following issues that are recommended and they have been negotiated between the developers, Commissions and City Staff 1) Requiring the minimum equivalent of one 2" front yard tree for each new lot created; 2) Significant individual trees and stands of trees to be identified on the grading plan for protection consideration; 3) Common bury for the utilities in the road right-of-way; and 4) Encouraging builders to protect saved trees on individual lots with fencing. He stated that City Staff is requesting ratification of these particular elements in working with the developers toward a mutual agreement. These elements have been agreed to by developers. Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to table any action on this issue until a second meeting has been held with the developer. Further discussion: Mr. Boos explained that the four items have been met with virtually no resistance from developers. Councilmember Peterson inquired if we are presently enforcing this policy to which Mr. Boos replied, with regard to the front yard trees, yes. Councilmember Peterson expressed concern that policies are being enforced before Council has voted on them.
