Amendment rescinded. Voting Yes: Mayor Hardin, Councilmembers Beyer, Peterson, <br />Beahen and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to direct staff <br />to request specific questions and concerns from Terry Hendriksen, Ben Deemer and Dave <br />Bawden of the Planning Commission in direct relationship with Mr. Gromberg and the <br />memos to the City and that these specifics should be returned to Mr. Schroeder by May 19, <br />1995. They will be turned over to the City Attorney for his review and then passed on to <br />Mr. Gromberg for his response. <br /> <br />Further discussion: Mr. Schroeder stated he would have Mr. Gromberg prepare a response <br />and get it to Council. The City Attorney would not have to be involved. It's not a <br />disciplinary thing - we are asking for facts. We will have Mr. Gromberg speak to the facts <br />by writing a response to what we receive. Mayor Hardin felt we will send out a letter'to <br />these three people in response to one individual, just as they relate to this individual. Mr. <br />Schroeder added "pursuant to memos". Mayor Hardin stated we are out on a legal limb, <br />not on a fact-finding mission. <br /> <br />Motion carded. Voting Yes: Councilmembers Beyer, Peterson and Zimmerman. Voting <br />No: Mayor Hardin and Councilmember Beahen. ' <br /> <br />Mr. Schroeder stated that this is only for fact-finding based on these three memos. This <br />has nothing to do with disciplinary action or pending disciplinary action. ' <br /> <br />Councilmember Beyer commented that this is correct <br /> <br />Mayor Hardin stated "your scope is not broad - it is aimed at one person". <br /> <br />Mr. Sehroeder stated that the memos predominantly are addressing concerns and one <br />person. He offered to provide, if necessary, an insert to Mr. Gromberg's response. <br /> <br />Councilmember Beyer felt this is the only way to go. Mr. Gromberg's name has been <br />muddied; he should have a chance to clear his name. She asked Mayor Hardin why he <br />didn't want Mr. Gromberg to have a chance to clear his name. Memos and charges have <br />been presented and if we do not respond, we are shirking our responsibility as a governing <br />body. I would think Mr. Gromberg would like an opportunity to clear his name. We are <br />giving him that chance. <br /> <br />Mayor Hardin stated that Councilmember Beyer suggested disciplinary action last night. <br /> <br />Councilmember Beyer stated that she requested Mr. Schroeder to do something about this <br />three weeks ago. He didn't do it, so she thought she would take the matter in her own <br />hands. <br /> <br />Mr. Sehroeder stated we are at a different spot today than we were yesterday. It started <br />with a request for disciplinary action but now it's a request for fact-finding. That may not <br />have anything to do with Mr. Gromberg. This is a place to start. He added he didn't think <br />it would end up with Mr. Gromberg. Maybe we will all learn from the facts found.' <br /> <br />Councilmember Zimmerman felt that the worst thing Council can do is nothing. <br /> <br />Mr. Schroeder reported that when he and Councilmember Beyer talked about this, we <br />knew something had to be done. He felt the issue was larger than one individual. They <br />talked and came to a sort of agreement.
