Ms. Frolik stated there are other lots available but the City does not have the authority to <br />force Mr. Anderson to sell his property. <br /> <br />Mayor Hardin asked if anyone is interested in sitting down and trying to "hammer some of <br />this stuff out". <br /> <br />Mr. Tom Anderson stated that they have been trying to do that. "We want to meet and <br />reach a consensus. We have no idea what their position is week to week". With regard to <br />hours of operation - the maintenance hours start at 6:00 a.m. but he feels noise is not a <br />problem. <br /> <br />Councilmember Beyer mentioned that mediation works sometimes when tempers are too <br />hot. <br /> <br />Mr. Anderson suggested that it would be hard for City Council to make a decision on this <br />issue without looking at the property. <br /> <br />Councilmember Beahen inquired if Council could go out and review the property. She felt <br />that with all this discussion, she needed to be more informed. <br /> <br />Councilmember Beyer agreed that she too would like to review the property. <br /> <br />Mr. Schmidt stated that a maintenance building is not mentioned for the PUD - it's a golf <br />cart storage building. "We are now putting a twist back. I want to be straight forward. <br />These people have financial and political clout - I have none. If they do not have a better <br />site, then give them the CUP and keep it right where it is or until Tom wants to sell land." <br />With regard to safety, Mr. Schmidt suggested signs be placed on Highway//47 that say <br />"stop, think, etc.". "Some signs on the highway would back up some concerns." <br /> <br />Motion by Councihnember Beyer and seconded by Councilmember Zimmerman to table <br />this issue until after a meeting is scheduled with Council, the golf course personnel, <br />residents, and City staff. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Zimmerman, Beahen <br />and Peterson. Voting No: None. <br /> <br />Case #5: Request for a Dwelling Moving Permit; Case of Reggies <br /> Mobile llome Transport and Fred Mertens <br /> <br />Zoning Administrator Frolik reported that Fred and Jeanette Mertens have purchased Lot 8, <br />Block 1, Pineview Estates 2nd Addition. They have submitted a request for a Dwelling <br />Moving Permit to place a modular home on the lot. The structure and its placement are in <br />compliance with the State Building Code and the City's zoning ordinances. The structure <br />will be placed on a full basement with a tuck-under garage. The exterior facing finish is <br />vinyl siding with fiberglass shingles. She explained that the Planning Commission has <br />reviewed the request and, along with staff, are recommending approval of the request. <br /> <br />Mr. Mertens presented pictures of a similar home. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt <br />Resolution #95-07-160 approving the application for a Dwelling Moving Permit to place a <br />modular home on Lot 8, Block 1, Pineview Estates 2nd Addition, and declare terms of <br />permit as proposed. <br /> <br />Motion carried.
