Case /t9: Award of Contract for Improvement Project /195-15 (Sanitary <br /> Sewer, Walermain, Storm Sewer, and Street Improvements for <br /> Fox Knoll Subdivision <br /> <br />City Engineer Jankowski stated that bids were opened for Improvement Project #95-15; <br />sanitary sewer, watermain, storm sewer, and street improvements for Fox Knoll <br />Subdivision. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Peterson to adopt <br />Resolution #95-07-159 awarding contract for Improvement Project/195-15 to H & M <br />Asphalt in the amount of $120,636,.50. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen and Peterson. <br />Voting No: Councilmembers Beyer and Zimmem~an. <br /> <br />Case #10: <br /> <br />Proposed Ordinance to Amend City Code Regulations for Work <br />tIours <br /> <br />Zoning Administrator Frolik pointed out that City Code restricts construction work hours <br />from 6:00 a.m. to 10:00 p.m., Monday through Saturday. The City has received a <br />complaint that on one or two occasions, the subcontractors working on the Ramsey School <br />expansion project started work before 6:00 a.m. Adolfson and Peterson, the general <br />contractor on the project, has notified all subcontractors that the Ramsey Police Department <br />has been authorized to issue citations for any further violations of the 6:00 a.m. start time. <br />Ms. Frolik reported that Mr. Ed Juskiewicz, the person lodging this complaint, surveyed <br />other cities relating to their construction work hours. A lot of the other communities have a <br />start time of 7:00 a.m. She stated that a call from the contractor indicated they prefer to <br />start early in the hot weather. <br /> <br />Councilmember Beyer inquired if it was the same individual who complained on both <br />occasions to which Ms. Frolik replied yes. <br /> <br />Councilmember Zimmennan felt that one complaint was not enough to change the code. <br /> <br />City Administrator Schroeder stated that when Mr. Juskiewicz brought this to staff's <br />attention, he was told that most places start at 6:00. Mr. Juskiewicz then surveyed other <br />communities and all but a few had a 7:00 a.m. start time. We felt it then made sense to <br />have Council consider this issue. <br /> <br />City Engineer Jankowski stated he talked to the contractor and he said they usually start at <br />7:00. He did not know of any time they started earlier. <br /> <br />Ben Deemer, a member of the Planning Commission, stated that when the City put the <br />construction hours in the Code, two of the present Council people were on the Planning <br />Commission at that time. lte stated he has not heard one complaint in 10 years and felt that <br />a change in the code now might be over-reacting. As a Planning Commission member, he <br />would not recommend a change. <br /> <br />Terry Herman, John Oliver & Associates, stated they work in a lot of different <br />communities that have 7:00 as a start time but there's a lot of cities that tell us we may start <br />earlier than that. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to leave <br />the City Code as it is as it pertains to work hours. <br /> <br />Motion carried.
