Case #4: Adopt Proposed Ordinance Vacating a Portion of the Drainage <br /> and Utility Easements Across Lots 4 and 5, Block 2, River's <br /> Bluff Second Addition <br /> <br />City Administrator Schmeder stated that at the July 25, 1995 meeting, Council introduced <br />an ordinance vacating a portion of the drainage and utility easements across Lots 4 and 5, <br />Block 2, River's Bluff Second Addition. This vacation was at the request of the property <br />owner and is required to facilitate the proposed home to be constructed on both of the lots. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Beyer to adopt <br />Ordinance/t95-13 authorizing vacation of the drainage and utility easements dedicated <br />along the common lot line of Lots 4 and 5, Block 2, or River's Bluff 2nd Addition. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer, Peterson <br />and Zimmerman. Voting No: None. <br /> <br />Case #5: <br /> <br />Award of Contract for Improvement Project 6'94-20 (Sewer and <br />Water Extension to Anoka Electric Cooperative Property) <br /> <br />Ma.yor Hardin announced that he would abstain from discussion of this case and also from <br />voting. <br /> <br />City Administrator Schroeder called attention to a letter received this day from an attorney <br />for Bury and Carlson. The letter is asking Council to table awarding of this contract <br />temporarily. Bury and Carlson is concerned about costs that will be incurred; however, <br />there is no reported financial impact on that property owner. If Council is concerned about <br />it, we would hold off awarding the project until after a meeting has been held with Bury <br />and Carlson. <br /> <br />Councilmember Beyer stated she would feel more comfortable voting on this if she had <br />been able to look at the letter prior to the meeting. She wanted more time to familiarize <br />herself with it. <br /> <br />Mr. Schroeder reiterated that the letter was just received today and that Bury and Carlson's <br />concern is basically what it will cost them and this is not proposed as an assessment <br />project. They have said they would like the opportunity to talk about other issues they may <br />have. He stated again that the project could be stopped if there is concern. <br /> <br />City Engineer Jankowski reported that about three weeks ago, he spoke with Mr. Norm <br />Bury and indicated to him that the City had this project coming up. He also talked to him <br />and his attorney yesterday; therefore, he has spoken with him twice about the project, <br />contrary to what is stated in the letter. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Peterson to adopt <br />Resolution g95-08-169 awarding contract for Improvement Project #94-20, sewer and <br />water extension to AEC property, to Arcon Construction in the amount of $818,246.01, <br />contingent upon a meeting with Bury and Carlson to iron out any concerns they may have. <br /> <br />Motion carried. Voting Yes: Councilmembers Beahen, Peterson, Beyer and Zimmerman. <br />Voting No: None. Abstain: Mayor Hardin. <br /> <br />City Council/August 8, 1995 <br /> Page 6 of 15 <br /> <br /> <br />
