snowmobilers would wait until there is a cushion of snow, there would not be much <br />damage. <br /> <br />Eugene Knudson, 8041 - 154th Lane NW, Ramsey, stated it does not make sense to ride in <br />the ditch when we have to maintain them all summer and they destroy them in the winter. <br />He presented pictures showing damage to his yard. <br /> <br />Mayor Hardin acknowledged these as some of the same complaints received in the past. <br /> <br />City Attorney Goodrich stated that he and Chief Auspos have serious reservations about the <br />method of enforcement of this proposed amendment to the snowmobile ordinance. He <br />stated his concern is it may not afford due process to those charged. We are recommending <br />that Council not adopt the amendment at this time. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />The public hearing closed at 7:15 p.m. <br /> <br />Council Business <br /> <br />Mayor Hardin called the regular portion of the City Council back to order at 7:15 p.m. <br /> <br />Mayor Hardin felt that after reading this proposal, it would be cumbersome and very <br />difficult to enforce. He expressed a concern about the legal issues mentioned by the City <br />Attorney also. He noted that other issues/concerns by residents are not addressed in this <br />proposal. <br /> <br />Councilmember Beyer stated we are going to have another winter of property damage. The <br />intent of getting started on this early was to have something done before snowfall. <br /> <br />Councilmember Zimmerman inquired if something could be drafted by the City Attorney. <br /> <br />Mayor Hardin added that we need to have serious discussions about restricting riding in <br />one way or another. <br /> <br />City Adminisa'ator Schroeder replied to Councilmember Zimmerman that Mr. Goodrich <br />could indeed draft something but he will need specifics from the Council. He reported that <br />he and Mayor Hardin felt it might be reasonable to try to ban snowmobiling in a portion of <br />Ramsey - as a sort of pilot program to see what happens. <br /> <br />Councilmember Peterson agreed that this might be reasonable but felt that the urban area is <br />not really the problem area. <br /> <br />Chief Auspos stated that different types of problems occur throughout the City. In the <br />MUSA, where you can only ride on the su'eets, there are fewer complaints. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to schedule a <br />special Council meeting to again discuss snowmobiling in the City for Monday, October <br />30, 1995, at 6:30 p.m. <br /> <br />City Council/October 24, 1995 <br /> Page 5 of 19 <br /> <br /> <br />
