Abstain: Mayor Hardin. <br /> <br />Case g'/: Investigation of Underage Liquor Sales Lighthouse Grill and <br /> Bar <br /> <br />Police Chief Auspos stated that, as Council is aware, a previous case dealing with a liquor <br />license application addressed an incident at the Lighthouse Grill and Bar alleging that there <br />had occurred there the sale of alcohol to two minors. At the time this incident occurred on <br />October 6, 1995, the license holder for the premises was Successful Concepts <br />Development, Inc. (SCD, Inc.), d.b.a. Big Shots. SCD, Inc. at that time had a <br />management agreement with Barnyard Entertainment, Inc. to conduct the management, and <br />the d.b.a, name was changed to Lighthouse Grill and Bar. During this time period, <br />Barnyard Entertainment, Inc. had submitted to the City, an application for an on- <br />sale/Sunday liquor license at that location, and there was a background investigation in <br />progress. Because of that investigation and, due to a lack of required information from <br />Barnyard on their license application, further consideration of that application was tabled <br />and the police report not accepted. He explained that the investigation into the alleged <br />liquor sales to minors has been completed and the Ramsey City Prosecutor has denied the <br />complaint. This denial is based on insufficient evidence to prove beyond a reasonable <br />doubt that the vendor(s) committed a criminal act. Chief Auspos concurred with Mr. <br />Fitzpatrick's opinion. <br /> <br />City Attorney Goodrich elaborated that a thorough investigation had been made. Several <br />individuals were spoken to and statements were obtained which led to Mr. Fitzpatrick's <br />decision. He summarized the State Statutes pertinent to revocation of a liquor license. <br /> <br />Mayor Hardin suggested that at this time, it might be a good idea to send letters to liquor <br />establishments in Ramsey to remind them to follow laws and that Chief Auspos and City <br />Administrator Schroeder should determine who the letters should come from. He also <br />suggested a sting operation and that once plans for that are made, it should be reported back <br />to Council. We need to let the establishments know that we take liquor licensing very <br />seriously and would not hesitate to take action should a violation occur. <br /> <br />Councilmember Beahen noted that in the report from City Prosecutor Fitzpatrick, it was <br />noted that Martinson apparently "snuck by" the carder. She inquired of Mr. Carlson from <br />the Lighthouse what will be done to assure that this type of incident will not happen again. <br />Also, there should be emphasis on the fact that it is the responsibility of the establishment <br />to make sure their patrons do not drink to the excess, then leave and cause an accident or <br />death. <br /> <br />Bob Carlson stated the Lighthouse does have a door man at the entrance to card people as <br />they enter. He did not know how Martinson snuck by but that they will continue to have a <br />doorman located at the door. He stated that the employees receive alcohol awareness <br />training and that they do everything in their power to make sure overserving does not take <br /> <br />City Council/November 28, 1995 <br /> Page 10 of 13 <br /> <br /> <br />
