1991, it was reissued. The permit had an expiration date of July 31, 1992. In October <br />1995, the City received an application for a new CUP for grading, importing and exporting <br />soils in order to complete excavation of the lake area and create walkout style home sites. <br />The Planning Commission conducted a public hearing and no verbal or written comments <br />were submitted. The revised plan reflects an intent to export approximately 890,000 yards <br />of sand from the 80-acre site, two-thirds of which is associated with the excavation of the <br />second lake. The applicant has also requested permission to import topsoil and clean <br />organic material, which would increase the amount of export material. The applicant is also <br />requesting that the permit be issued for a time frame beyond the usual three-year limit. The <br />Planning Commission and City staff recommend approval of the request for the CUP. The <br />Planning Commission has stated that the decision as to whether or not the permit should be <br />granted beyond the three-year time frame established in City Code is one that is <br />appropriately made by Council. <br /> <br />Dennis Peck explained more about the excavation plan. He noted that in the findings of <br />fact, gl 1 talks about 70,000 yards of top soil. He stated that they really do not know what <br />that exact number will be and asked that this be taken into consideration;. Number 13 in <br />the resolution says that the imported top soil shall not be placed more than 12 inches in <br />depth. He stated that would be fine except they are working with the golf course and they <br />would like to use some for berm. Mr. Peck added that he could work with the City <br />Engineer as to the placement of the berm. <br /> <br />Larry Koshak, 15700 St. Andrews Lane NW, Ramsey, stated he concurs with what staff <br />has put together. The neighbors are concerned about the amount of open area to be mined. <br />He felt it should be confined to a limit of two acres. He noted that #16 in the resolution <br />talks about the proposed area to be graded being roughly two acres in size but then it goes <br />on to say that excavation of the entire area shall be permitted. He asked what that meant. <br /> <br />City Engineer Jankowski explained that it's a maximum of five acres and before more is <br />disturbed, the previously disturbed area would have to be restored. <br /> <br />Mr. Koshak stated he concurs with the three-year limit. He inquired if the hours of <br />operation being 6:30 a.m. to 8:00 p.m. was the standard. <br /> <br />Ms. Frolik replied that the hours have been changed and start time is now 7:00 a.m. <br /> <br />Mr. Koshak stated he would like the end hours to be 7:00 p.m. to which Mr. Peck stated <br />that 7:00 a.m. to 7:00 p.m. is reasonable. <br /> <br />City Attorney Goodrich stated that the ordinance says a permit shall be issued for a <br />maximum of three years - then a new permit would have to be applied for. To extend the <br />permit length would require a variance. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to adopt <br />Resolution g95-11-262 adopting Findings of Fact g0390, as amended (gl 1 should read <br />"That the grading plan submitted proposes to export approximately 820,000 yards of sand <br />and import certain topsoil and other organic materials") relating to North Fork's request for <br />a conditional use permit to grade, import and export soils from Ouflot C, Northfork. <br /> <br />Motion carried. Voting Yes: Councilmembers Beyer, Peterson, Beahen and Zimmerman. <br />Voting No: None. Abstain: Mayor Hardin. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt <br />Resolution g95-11-263, as amended (#1 should read "This permit shall expire three years <br /> <br />City Council/November 28, 1995 <br /> Page 9 of 13 <br /> <br /> <br />
