Motion by Councilmember Zimmennan and seconded by Councilmember Beyer to adopt <br />Resolution g95-11-258 adopting Findings of Fact g0338 relating to a request from Amcor <br />for an interim use permit for a temporary office structure. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer, Beahen <br />and Peterson. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman and seconded by Couneilmember Beyer to adopt <br />Resolution tg95-11-259 approving the issuance of an interim use permit for 18 months to <br />Amcor for a temporary structure. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #5: <br /> <br />Request for an Amended Conditional Use Permit for a <br />Demolition Concrete and Asphalt Processing Facility; Case of <br />Bury and Carlson <br /> <br />Zoning Administrator Frolik noted that in August 1992, Council issued a conditional use <br />permit to Bury and Carlson to establish a heavy industrial use in the Business Warehouse <br />District. In September 1995, staff received a letter from Bury & Carlson requesting two <br />revisions to the terms of the CUP. Such revisions consist of eliminating the restriction on <br />hours of operation and the requirement for weekly sweeping of Jaspar Street and 143rd <br />Avenue. Regarding hours of operation, Bury and Carlson is restricted to 7:00 a.m. to 5:00 <br />p.m., Monday through Saturday. Regarding the requirement for cleaning City streets, <br />Bury and Carlson's permit requires them to sweep Jaspar Street and 143rd Avenue west to <br />Ramsey Boulevard a minimum of once a week. In October 1995, Council was advised that <br />Bury and Carlson had some interest in obtaining an amendment to their CUP. At that time, <br />Council determined that their request had some merit and directed that they proceed to apply <br />for an amendment in accordance with procedures established in City Code. Ms. Frolik <br />noted that similar businesses have no restrictions or more lenient restrictions than Bury and <br />Carlson. She stated that Norm Bury is present to answer any questions. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt <br />Resolution 695-11-260 adopting Findings of Fact g0389 relating to Bury and Carlson's <br />request for an amended conditional use permit. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt <br />Resolution g95-11-261 approving the issuance of an amended conditional use permit to <br />Bury and Carlson. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />Case #6: Request for a Conditional Use Permit to Grade, Import and <br /> Export Soils; Case of North Fork, Inc. <br /> <br />Mayor Hardin announced he would abstain from discussion and voting on this case. <br /> <br />Zoning Administrator Frolik stated that in 1987, the City issued a conditional use permit for <br />grading and excavating a lake in the Northfork P.U.D.
