Ms. Frolik advised him to contact City Administrator Ryan Schroeder about relocating, and she <br />informed him of the Economic Development Authority created to assist expanding businesses. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Holland to recommend that <br />City Council deny Mr. Bowman's request for a conditional use permit for a home occupation and <br />request that City Council enter into negotiations with Mr. Bowman for an agreeable time-frame to <br />relocate his business to a complying location. <br /> <br />Further Discussion: Commissioner Deemer advised that the Findings of Fact should be addressed <br />before making this motion, and Ms. Frolik agreed that the motion needed to be made based on <br />negative Findings of Fact. <br /> <br />The motion was withdrawn to address the Findings of Fact. <br /> <br />The Planning and Zoning Commission proceeded to review the Findings of Fact. <br /> <br />It was the consensus of the Commission that gl through g9 would remain as presented. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Holland to amend gl0 to <br />read "That the proposed use will be unduly dangerous or otherwise detrimental to neighboring <br />residences." <br /> <br />Further Discussion: Commissioner Deemer specified that emphasis was on "otherwise <br />detrimental." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Holland, <br />Deemer, LaDue, and Thorud. Voting No: Commissioner Terry. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend gl 1 to <br />read "That the proposed use will substantially adversely impair the use, enjoyment or market value <br />of any surrounding property." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, <br />Holland, LaDue, Terry, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend g12 to <br />read "That the proposed use will be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity and the <br />proposed use will change the essential character of the area." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, <br />Holland, LaDue, Terry, and Thomd. Voting No: None. <br /> <br />Motion by COmmissioner Deemer and seconded by Commissioner Terry to amend gl3 to read <br />"That the proposed use will be disturbing to existing or future neighboring uses." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />Holland, LaDue, and Thom& Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend g14 to <br />read "That the proposed use will not be served adequately by essential public facilities and services <br />such as streets, police and fire protection." <br /> <br />Planning & Zoning Commission/February 1, 1994 <br /> Page 7 of 9 <br /> <br /> <br />
