Motion by Commissioner Hendriksen and seconded by Commissioner Thorud to amend #21 to <br />read "That the proposed use will not create excessive additional requirements at public costs for <br />public facilities and services, and it will not be detrimental to the economic welfare of the <br />community." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Thorud, <br />Deemer, and L',ff)ue. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend 4/22 to <br />read "That as proposed, the use will not involve activities, processes, equipment and conditions of <br />operation that will be detrimental to any persons, property, or the general welfare by reason of <br />excessive production of traffic, noise, smoke, fumes, glare or odors." <br /> <br />Further Discussion: Commissioner Hendriksen stated that this number of vehicles coming to the <br />residence will involve a level of traffic that is detrimental. Commissioner Thorud didn't find four <br />vehicles to be excessive, noting that the property was on a county road and that the four vehicles <br />would not always be in use at once. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, and Thomd. <br />Voting No: Commissioner Hendriksen. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Deeme,' and seconded by Commissioner Hendriksen to amend//23 to <br />read "That the proposed use will not be consistent with the intent and purposes of Section 9.03.04 <br />(Conditional Use Permits) of the Ramsey City Code." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendfiksen to add a finding to <br />read "That the applicant's rep,'esentative stated that employees do come and go from the subject <br />property." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />and Thorud. Voting No: None. Absent: Comtnissioners Holland and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council adopt the Findings of Fact relating to Gordon Hicks' request for a conditional use <br />permit. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to recommend that City <br />Council deny Gordon Hicks' request for a conditional use permit based upon the negative findings <br />of fact. <br /> <br />Further Discussion: Commissioner Deemer stated that he would have been more receptive to <br />approving an interim use permit for Mr. Hicks to allow him to operate for a specified period of <br />time while seeking an appropriate zoning district in which to relocate his business. Ms. Frolik <br />advised against approving an iucompatible use in the residential district for even a limited amount <br />of time; that it might be better to go on record that the use is unacceptable and grant the applicant a <br />reasonable amount of time to relocate. <br /> <br />Planning Commission/August 2, 1994 <br /> Page 4 of 9 <br /> <br /> <br />
