Michael Froelich, attorney at law representing Gordon Hicks, reviewed the letters received into
public record. He addressed concerns regarding the size of operation and the impact on the
environment by describing the site and stating that all storage areas will be paved, and the outside
storage area will be surrounded by an 8-foot fence. He advised that Mr. Hicks is not operating his
business on the site but only storing the vehicles, and possibly making minor repairs; there will be
no storage of asphalt or other materials on the site. He stated there are no hazardous wastes
involved, and if there were to be any type of spillage, it would not contaminate the groundwater.
He noted the hours of operation are 7:00 a.m. to 9:00 p.m.

Commissioner Deemer inquired if Mr. Hicks would only be using one vehicle at a time.

Mr. Froelich stated it depended on the size of the job. He advised that Mr. Hicks did have other
employees that will be parking and moving the trucks.

ADJOURNMENT

Motion by Commissioner Thorud and seconded by Commissioner Deemer to adjourn the public
hearing.

Amendment by Commissioner Deemer and seconded by Commissioner Hendriksen to incorporate
into the public record, by reference, all the letters listed in the "Hicks Complaint Time Line,"
attached hereto as attachment D.

Amendment carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen,
LaDue, and Thorud. Voting No: None. Absent: Commissioners Holland and Terry.

Motion carried.
