Motion by Commissioner Terry and seconded by Commissioner Thorud to amend #16 to read <br />"That the proposed use will not create excessive additional requirements at public cost for public <br />facilities and services." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Terry, Thorud, Deemer, <br />Hendriksen, Holland, and LaDue. Voting No: None. <br /> <br />Motion by Commissioner Thorud and seconded by Commissioner Terry to amend #17 to read <br />"That the proposed use will not involve uses, activities, processes, materials and equipment, and <br />conditions of operation that will be detrimental to any neighboring properties or persons by reason <br />of excessive production of traffic, noise, or odors." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Thorud, Terry, Deemer, <br />Hendriksen, Holland, and LaDue. Voting No: None. <br /> <br />Chairperson Bawden stated that he believes it is possible for golf balls to go onto adjacent <br />properties unless there is something to prevent that. <br /> <br />Mr. Ritter stated that if and when the adjacent area is developed he would be willing to do <br />something to prevent stray golf balls, but not at the present time when there is just a vacant field <br />there. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to add a finding to read <br />"It is not perceived how golf balls can be stopped from straying from the subject property to <br />neighboring properties." <br /> <br />Further Discussion: Commissioner Hendriksen noted that it's not that this can't be done, but that <br />it's not being done. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />Holland, LaDue, and Thorud. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council adopt the Findings of Fact relating to KRS Investments' request to expand an outdoor <br />recreational facility in the Industrial District. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, LaDue, Terry, and Thorud. Voting No: None. <br /> <br />The Planning Commission proceeded to review the terms of the CUP. <br /> <br />Commissioner Hendriksen noted concern about this being an enticement for kids to go down to the <br />railroad tracks to pick up golf balls. <br /> <br />Mr. Ritter stated it was not his intent to infringe on the neighbors' rights or to put people at risk. <br />He added that he would be more than happy to extend the netting to prevent balls from going down <br />to the tracks. <br /> <br />Commissioner LaDue stated it was his position that if this activity exposes KRS Investments to <br />liability, they will take care of it on their own or they wouldn't even be in business. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Thorud to add a term to read <br />"The Permit Holder shall be responsible to remedy any complaints of stray golf balls from <br />adjoining property owners within 90 days." <br /> <br />Planning Commission/October 4, 1994 <br /> Page 4 of 10 <br /> <br /> <br />
