We are charged with reviewing the <br />decision and the information that is. received f. rom all parties at the hearing, and <br />ce{tiffing if the action complies with the intent or the Wildand Scenic River~ Act and <br />Critical Area Executive Order, the minimum standards and criteria, and the <br />considerations listed above. <br /> <br />Within 30 days of receipt of the decision and information, DNP,. mu~t communicate <br />to the City either certification of approval, with or without conditions, or notice of <br />nonapproval. The action becomes effective only with certification by the <br />Commissioner or when 30 days have elapsed and no communication from the DNR <br />has been received [MN Rules, part 6105.0230, subp. 3]. <br /> <br />Because of prior commitments, there will not be a DNR representative present at <br />the hearing. If the variance is granted, our decision on certification will rely on the <br />materials submitted, the minu~es of the hearing testimony and discussion, and the <br />City's findings of fact, conclusions, and order.
