Ms. Frol~ explained the difference is that the original PUD was to be when City sewer and
water came in.

Mr. Goodrich stated that, if approved, it will become a policy question; whether it becomes
a legal question depends on the next applicant's actions, ff the differences were presented
in court, the ruling is questionable.

Mr. Dom stated the point is that he is asking for a reduction in density, and that if someone
else cort~s in and can match their project of a PUD with condominium approval and asking
for a reduction in density, then it should be granted.

Councilmember Hardin inquired whether The Metropolitan Council would respond if the
City outlined this particular case and requested whether approving it would endanger
MUSA expansion.

Mr. Schroeder replied that when he contacted The Metropolitan Council he only asked for
their comments. He added that he could send them another letter inquiring how this can be
approved without endangering MUSA expansion.

Councilmember Beyer noted that there are townhouses on Bunker Lake Boulevard across
from Majestic Oaks which is outside the MUSA.

Mr. Dom replied that that city does not currently have any requests for MUSA expansion,
nor do they have any intentions of doing so in the future.

Mayor Gilbertson expressed regret that the City has to worry about what the Metropolitan
Council is going to do to the southern half of Ramsey if the City approves this request.

Councilmember Peterson inquired if Mr. Dom is going to wait until MUSA has been
clarified.

Mr. Dom agreed that he will wait. He stated he only wants to proceed with the process of
the public hearing, but he does not want to jeopardize the MUSA.

Mr. Goodrich inquired why Mr. Dom needs sketch plan approval at this time.

Mr. Dorn~explained he needs sketch plan approval to proceed with the first public hearing.
He stated he would like the City to see that the people are not going to be happy with what
was agreed to if the condominiums come in instead of townhouses. Again, Mr. Dom
agreed that the project would be put on a shelf to see what happens with the MUSA
expansion.

Councilmember Zimmerman expressed his concern about jeopardizing the MUSA and
stated he would like to see this resolved with the Metropolitan Council before making a
decision on the townhouses.

Ms. Frolik mentioned that ultimately this higher density housing would have to be
approved without sewer and water.

Councilmember Peterson suggested setting guidelines for making exception to the 4 in 40.

The Council inquired of the City Engineer his comments on approving townhouses with
septic systems.

City Council/March 8, 1994
