Upon request, Mr. Goodrich stated the "worst case scenario" would be as follows: the <br />City takes the 50 acres - the lien remains on the property - the City does the improvements - <br />the State takes back the property - the State gets the improvements. <br /> <br />Mr. Schroeder asked that Council allow him and City Attorney Goodrich to try to bring <br />closure to this deal. He reiterated that the leverage with Waste Management has changed <br />significantly. <br /> <br />Mr. Goodrich felt that the City should continue to look at the 22 acres as part of the deal. <br /> <br />Councilmember Peterson stated that if Waste Management has promised to give something <br />to the City, they cannot back out. <br /> <br />Mr. Goodrich stated that Waste Management could give the property to the City but it could <br />have a lien on it by the State. <br /> <br />Councilmember Hardin stated that Waste Management has to give the City something in <br />return for the ski hill. <br /> <br />Mr. Goodrich stated PCA will be contacted to determine what the status of this issue is. <br /> <br />Mayor Oilbertson commented that there is no incentive for Waste Management to give the <br />City the additional 22 acres. <br /> <br />Councilmember Hardin suggested that there may or may not be an incentive and felt that the <br />City should not make any changes right now. <br /> <br />Consensus of the Council was to bring back a resolution of agreement with the City, Waste <br />Management, and the Pollution Control Agency. <br /> <br />Case #12: Report from Road & Bridge Committee <br /> <br />City Engineer Jankowski stated that the Road and Bridge Committee met earlier this <br />evening and discussed priority street lighting costs. It was determined that these costs <br />should be a discussed by the Finance Committee. <br /> <br />Consensus of the Council was that the issue of priority street lighting costs should be <br />forwarded to the Finance Committee for discussion. <br /> <br />Mr. Jankowski reported that the Road and Bridge Committee also discussed receiving the <br />feasibility report on 153rd/155th Avenue MSA road extension. The Committee was <br />presented with three alteraative route designs, one of which completely avoided any impact <br />to the wetland. The Committee recommended that this alignment be chosen and directed <br />that Staff place this issue on the July 26, 1994 Council agenda, and that letters regarding <br />this meeting be sent to the residents who are affected by the extension and to those who had <br />expressed an interest in the project. <br /> <br />Motion by Councilmember Zimmerman and seconded by Mayor Gilbertson to place the <br />discussion of an alightment for the 153rd/155th Avenue N.W. extension on the July 26, <br />1994 and that the alternative (called Alternative C) be the recommended alignment because <br />of no impact to the wetland.
